Service Specific Terms & Conditions - Maxis Postpaid Share 39 ("SSTC")

Version [29th February 2024]

    1. Plan: Maxis Postpaid Share 39.
    2. You: Person(s) signing up for the Plan.
    3. Selected Region(s):
      1. Kelantan; and
      2. East Malaysia: Sabah, Sarawak and WP Labuan.
    4. The use of the Plan and Service(s) is subject to the General Terms & Conditions (“GTC”) at https://www.maxis.com.my/en/terms-conditions/general/maxis-consumer/, this Service Specific Terms & Conditions – Maxis Postpaid Share 39 (“SSTC”), Maxis Fair Usage Policy at https://www.maxis.com.my/en/terms-conditions/general/maxis-fair-usage-policy/ and any other applicable terms and conditions available, all at  www.maxis.com.my/terms-conditions/personal/.
    5. Capitalised terms herein have the same meaning as defined in the GTC.           
    6. Any conflict or inconsistency between this SSTC, the GTC and Summary Terms and Conditions (“STC”), shall be construed in the following order of precedence: (a) SSTC; (b) GTC; and (c) STC.         
    7. We reserve the rights without liability, to revise this SSTC, Plan and our pricing. Where reasonably practicable, we will give you reasonable advance notice of such changes and all previous versions of our user guides or leaflets will be superseded. You accept you are responsible for regularly reviewing information on the Plan and Service(s) at  www.maxis.com.my/tnc, including changes to the Agreement. Your continued use of the Service(s) and/or Plan (after the Effective Date of any revision/change to the terms and conditions of Service(s) and/or Plan) shall constitute unconditional acceptance by you of such revisions/changes and you shall be bound by the same. If you do not accept such revisions/changes, you will terminate the Plan and/or the use of the Service(s) by giving us notice within fifteen (15) working days from the Effective Date, failing which you are assumed to have accepted the changes. 
    1. Subscriptions for this Plan(s) must be made and submitted: -
      1. by walking into any Maxis Centres, Maxis Exclusive Partners, and/or Maxis’ authorized dealers in the Selected Regions; or       
      2. via our telesales campaigns or promotions.
    2. You must be an individual who resides in the Selected Regions with a valid billing address in the Selected Regions. We will require you to provide evidence such as NRIC, passport or utilities billing address for validation purposes.
    3. Further, You must be the principal account holder of any of the following plans to be eligible to subscribe to this Plan:
      1. Maxis Postpaid 98, 108, 128, 158, 188, 248 or 368: SSTC – Maxis Postpaid (Pre-15th August 2023) (https://www.maxis.com.my/en/terms-conditions/products-services/mobile/postpaid); 
      2. Maxis Postpaid 68: SSTC – Maxis Postpaid 68 (https://www.maxis.com.my/en/terms-conditions/products-services/mobile/postpaid-68/);
      3. Maxis Postpaid 79, 109, 139, 169 or 199: SSTC - Maxis Postpaid (https://www.maxis.com.my/en/terms-conditions/products-services/mobile/postpaid-plan); or 
      4. Maxis Postpaid 69 or 99: SSTC – Maxis Postpaid 69 & 99 (https://www.maxis.com.my/en/terms-conditions/products-services/mobile/postpaid-69-and-99/).
    4. You are ineligible for this Plan if you owe us any payments. 
    5. This Plan is inapplicable to you if you are a commercial user and/or bulk subscriber.

     

    1.  The Plan’s structure is set out in the attached Appendix and also published on our website at https://www.maxis.com.my/en/mobile-plans/maxis-postpaid-69-and-99, as may be updated by us from time to time. Charges published are exclusive of all applicable taxes including SST. 
    1. A deposit of RM150 is chargeable to non-Malaysian principal account holder of any of the plans set out in Clause 10 above when signing up for this Plan.
    2. Non-payment of the Bill may result in suspension or barring of all the Services until the outstanding amount is paid.
    1. You agree and accept that the unlimited Minutes Allocation for Voice and unlimited SMS' Allocation applicable to the Plan only applies to the following: 
      1. domestic mobile ON-net usage (Maxis to Maxis calls and SMS’) for Maxis Postpaid lite & start (excluding OFF-net usage (calls and SMS’ from Maxis to other Service Provider), calls to fixed lines, video calls, calls to numbers with special charges e.g. 1-300/1-700/600 & 121, TM100, 1MOCC and 080-prefix numbers for border calls to Brunei).      
      2. domestic mobile/fixed ON-net & OFF-net usage for Maxis Postpaid 68, 69, 79, 98, 99, 108,109, 128, 139, 158, 169, 188, 199, 248 & 368 (excluding, video calls, calls to numbers with special charges e.g. 1-300/1-700/600, 121, TM100, 1MOCC & 080-prefix numbers for border calls to Brunei).
      3. standard person-to-person calls or texts and not for any commercial and/ or non-personal usage;
      4. non multiple simultaneous calling, conference calling (unless you are subscribed to the conference calling service with Maxis), re-supply, call centre usage, telemarketing, bulk messaging, application-to-person communication, continuously call forwarding, auto-dialing, machine-to-machine communication (including by using your SIM card in any other devices), Cellular Trunking Units (CTUs), or any other activity we consider to be non-standard usage.
    2. Please refer to Appendix attached to this SSTC for applicable Charges on calls and SMS made outside of the scenarios in Clause 16 above.

     

    1. For data allocated with the Plan, you agree and accept:
      1. You will experience data browsing at reduced speeds and with no EXCESS charges if any usage exceeds the allocated mobile internet; 
      2. The mobile internet package allocated within the Plan is exclusively for domestic usage only;
      3. You may purchase one-time passes to add more data (non-recurring) BEFORE you exceed your mobile internet package allocation. Such upgrade is available through your UMB, Maxis app, Maxis Online Account or WAP menu and accessible through your Mobile Phone, other available Devices or channels as we may inform you from time to time. 
      4. You can opt for upgrades or downgrades of the Plan at any Maxis stores or call our Contact Centres (123); and
      5. If you upgrade or downgrade your existing plan to the Plan, the monthly fees of your existing plan and the new Plan will be pro-rated against your billing cycle date. However, you will start enjoying the Mobile Internet Package allocation of your Plan upon effective upgrade or downgrade. You will be charged the full monthly fee applicable to the Plan the following billing cycle.
    1. The rates outlined in the Plan structure do not account for usages while on an overseas roaming network. Whilst roaming overseas, the prevailing data roaming charges at https://www.maxis.com.my/lifestyle/roaming-idd/international-roaming/ shall apply.
    1. For 5G service(s), you agree and accept that the 5G service(s) terms and conditions as stipulated in the Plan at https://www.maxis.com.my/en/terms-conditions/products-services/mobile/postpaid-plan or https://www.maxis.com.my/en/mobile-plans/maxis-postpaid-69-and-99/ shall apply to you.
    1. We reserve the rights at any time, without being liable to you or any third party, to interrupt, bar, suspend, restrict the Service(s) for such time as we see fit or terminate, discontinue or disconnect the Service(s) if your usage:
      1. shows excessive usage or placing unusual burdens on our Network; 
      2. is for unlawful activities or for suspected fraudulent activities; 
      3. is not in accordance with the Maxis Fair Usage Policy (at www.maxis.com.my/FUP); 
      4. is for commercial/non-personal purposes; or 
      5. in our determination, your usage of mobile data, voice and SMS’ is used or originating from outside of the Selected Region that you have registered with us for more than three (3) consecutive months.
    2. If you change your current rate plan to the Plan, you will not be able to carry forward any promotions/benefits that you are currently enjoying under your existing rate plan to your new Plan.
    3. In connection to the Plan survey, comments, suggestions and/or feedback submitted by you to Maxis, you agree that Maxis may use all comments, suggestions and feedback collected in any manner without restriction or obligation for any purpose, including but not limited to incorporation or implementation of such comments, suggestions and feedback into Maxis’ product or service, to develop, improve and/or evaluate the Plan. Except for personal data, no comments, suggestions and/or feedback will be deemed as your confidential information.
    1. Subject to our GTC, a principal line holder may at any time terminate the Plan as follows: 
      1. by calling our customer care line at 1-800-82-1123 or dial 123 from your mobile;
      2. by walking into our Maxis Centres listed on www.maxis.com.my; or
      3. by writing in to customercare@maxis.com.my.
