Service Specific Terms & Conditions (“SSTC”) – Maxis Trade-In Programme

    1. Maxis Trade-In Programme is a Device buy-back and trade-in programme (“Programme”) offered and provided by Maxis to our customers via Maxis Trade-in app and the Programme is operated by CompAsia Sdn Bhd (Registration No. 202101022161 (1006653-T)(“CompAsia”).
    2. Device” means a mobile wireless device that (i) has a display screen; (ii) supports one or more wireless network connectivity options; and (iii) is operated using voice, touch or a miniature keyboard; such mobile wireless device including mobile phones and tablets;
    3. By participating in the Programme, you agree to be bound by our General Terms and Conditions (“GTC”) at https://www.maxis.com.my/en/terms-conditions/general/maxis-consumer/, Summary Terms and Conditions (“STC”) and this Service Specific Terms & Conditions - Maxis Trade-In Programme (“SSTC”), which may be updated by Maxis from time to time.
    4. Capitalised terms herein have the same meaning as defined in the GTC.
    5. Any conflict or inconsistency between this SSTC, the GTC and STC, shall be construed in the following order of precedence: (a) SSTC; (b) GTC; and (c) STC.
    6. We reserve the rights without liability, to revise this SSTC, the terms and conditions of the Programme and our pricing. Where reasonably practicable, we will give you reasonable advance notice of such changes and all previous versions of our user guides or leaflets will be superseded. You accept that you are responsible for reviewing or regularly reviewing information on the Programme available at https://www.maxis.com.my/en/devices/trade-in/ including changes to the Agreement.
    1. Some of the information provided in the Maxis Trade-In app is supplied by CompAsia. You understand and accept that we have not necessarily checked the third-party contents provided by CompAsia and we make no representation and warranty about the market value or price of the eligible device (“Eligible Device”, as listed on our website at https://www.maxis.com.my/en/devices/trade-in/#trade-in) that you might be able to obtain elsewhere.
    2. In respect of the third party content provided in the Maxis Trade-In app, you acknowledge and agree that your participation to the Programme and/ or download, access or use of the Maxis Trade-In app shall be subject to, and you shall review, accept and comply with, such terms and conditions (including any end user licence agreements) as may be applicable to such third party content (including contents from CompAsia) as contained in Maxis Trade-in app (“Third Party Content”). You shall be solely responsible for any provision or submission of information by or on behalf of you on or through Maxis Trade-In app and you further acknowledge and agree that Maxis shall not be responsible to the Third Party Contents or functionality of the Third Party Contents as contained in Maxis Trade-In app.
    3. This is a non-transferable Programme, whether by operation of law or otherwise, either to any other person, entity or account.
    4. We do not warrant the continuity, uninterruptible and/or error-free of the buy-back and trade-in service operated and managed by CompAsia under the Programme and we expressly disclaim any representations or warranties of title, non-infringement, merchantability, usage, fitness or technical function in relation to the Maxis Trade-In app.
    1. The Programme is open to all Maxis’ subscribers who are: -
      1. citizens or permanent residents of Malaysia;
      2. at least 18 years of age; and
      3. existing subscriber for any Maxis postpaid or Hotlink postpaid.
    2. You are not eligible to participate into the Programme if you: -
      1. have any outstanding payments with us; and/or
      2. are currently within the relevant device contract commitment period with us but you wish to trade-in the Device under such device contract. If however you still insist to trade-in the Device which is within the commitment period under the relevant device contract with us, you must pay the applicable early termination charges and fees in accordance with the relevant terms and conditions for the device contract before you are allowed to participate into the Programme.
    3. The list of the Device model eligibility and diagnostic checks for buy-back and trade-in under the Programme can be found from our website at https://www.maxis.com.my/en/devices/trade-in/#trade-in, which may be updated by Maxis from time to time.
    4. Any Device that is currently within the commitment period/ contract with Maxis on Maxis’ lease plans (eg. Zerolution/ Maxis Device Contract) is not eligible for trade-in.
    5. The Programme is strictly for access and transacted in Malaysia only.
    1. Maxis Trade-In app refers to a web-based diagnostic tool using mobile phone application to access and check whether a Device is eligible for trade-in. The app is available to be downloaded from App Store, Google Play Store and Huawei App Gallery.
    2. To assess Maxis Trade-In app and get a quote of your Device trade-in value, please perform the following: -
      1. Download Maxis Trade-In app;
      2. Getting the quotation:
        After running the device diagnostic on the Eligible Device you wish to trade-in, you will be required to declare the physical condition of your Eligible Device to get the quotation from CompAsia. If you are agreeable with the quote of the Eligible Device trade-in value and wish to sell/trade-in your Device at the given quote, you may proceed to fill-in your personal information and place an order.
      3. Surrender your Eligible Device:
        Walk into any Maxis outlets nationwide and speak to our friendly staff to complete the trade-in transaction or to get further assistance.
      4. Trade-in value:
        The final trade-in value of your Eligible Device will be issued in accordance with the following scenarios (wherever applicable):
        1. the final Device trade-in value will be used to offset the Charges when your trade-in transaction is completed and you wish to purchase any products in store at Maxis outlet and/or are required to pay for any Charges:
          1. If your final trade-in value is less than the Charges, you will be required to top up the balances to complete the purchase transaction; and
          2. If your final trade-in value is more than the Charges, the remaining balance of the final trade-in value will be credited and reflected in your Maxis/Hotlink postpaid bill in the next billing cycle.
        2. the final Device trade-in value shall be credited and reflected in your Maxis/ Hotlink postpaid bill in the next billing cycle if you do not wish to purchase any products when you complete the trade-in transaction. Such amount credited will be used to offset the Charges in your next postpaid bill.
        3. For clarity, no money in cash or whatsoever form will be issued to you as Device trade-in value.
    3. Please note that the final trade-in value of your Eligible Device shall be determined by our staff at Maxis outlets to complete the trade in transaction. Should you decide not to proceed with the trade-in of your old Eligible Device, please feel free to inform our staff at Maxis outlets.
    1. By participating in the Program, you represent and agree that you are authorized to trade in your Eligible Device to Maxis and CompAsia and that you have the ownership, title and interest in the Eligible Device submitted under the Programme. Upon CompAsia accepting the Eligible Device, title of ownership in such Eligible Device transfer to CompAsia through Maxis and you shall disclaim any further right, title or interest in and to the Eligible Device or any items contained therein.
    2. You agree to accurately submit the information of the make, model and condition of your Device via the Maxis Trade-In app. The quote shown on the Maxis Trade-in app is not final and that its final appraised value may be adjusted according to clause 18 herein.
    3. Before submitted the Eligible Device to CompAsia, you must back-up your contacts, photos, messages, music and anything else you want to keep (collectively, ‘‘Content”) and erase the Content, take out your device’s SIM card and reset your device to its factory settings.
    4. You agree that the Eligible Device that you submitted will not be returned to you, and that any Content cannot be recovered.
    5. Data recovery or data backup is not a part of the service under the Programme, accordingly we accept no responsibility or liability for any lost of Content, files or data in your traded-in Device. You hereby expressly agree to indemnity Maxis and Maxis’ directors, officers, employees, affiliates or agents from and against any claims brought against any of them in connection with the performance of the Programme and release us from any claims, losses or damages that may arise with respect to it.
    1. The trade-in quote and the final agreed trade-in value will vary depending on the type, the model and the working conditions of your Eligible Device and our decision shall be the final decision.
    2. The Eligible Device may be returned to you and you will not be entitled for the trade-in value if (i) the condition of your Eligible Device doesn't match that of your application; (ii) your Content or data is not wiped; or (iii) the device security locks or device tracking features are not disable.
    3. Under no circumstances Maxis shall be liable for any special, indirect, incidental or consequential damages resulting from the Programme.
