Service Specific Terms & Conditions (“SSTC”) – Maxis Fibre Pre-Installation Offer

General

  1. The Offer(s): Sign up for any Maxis Fibre plan and get free unlimited data 4G data until your Maxis Fibre is installed.
  2. Service(s): Free Unlimited 4G Data
  3. You: Person(s) signing up for any of the Maxis Fibre plans.
  4. This Offer is applicable to those participating in Maxis Fibre plans: Maxis Fibre Broadband 30Mbps, 100Mbps, 300Mbps, 500Mbps or 800Mbps
  5. Offer Period: 13 April 2020 until further notice
  6. The Offer(s) and use of Service(s) is subject to the General Terms & Conditions ("GTC"), this Service Specific Terms & Conditions ("SSTC"), Service Specific Terms & Conditions for Maxis Fibre Broadband ("Maxis Fibre SSTC"), Maxis Fair Usage Policy and any other applicable terms and conditions, all at www.maxis.com.my/terms-conditions/personal/
  7. Capitalised terms herein have the same meaning as defined in the GTC.
  8. Any conflict or inconsistency between this SSTC, Maxis Fibre SSTC and the GTC and Summary Terms and Conditions ("STC"), shall be construed in the following order of precedence: (a) this SSTC; (b)Maxis Fibre SSTC; (c) GTC and (d) STC.
  9. We reserve the rights without liability, to revise this SSTC, the Maxis Fibre SSTC, GTC, the Offer (s) and our pricing. Where reasonably practicable, we will give you reasonable advance notice of such changes and all previous versions of our user guides or leaflets will be superseded. You accept you are responsible for regularly reviewing information on the Plan(s) and Service(s) at www.maxis.com.my/tnc), including changes to the Agreement. Your continued use of the Service(s) and/or Plan(s) (after the Effective Date of any revision/change to the terms and conditions of Services and/or Plan(s)) shall constitute unconditional acceptance by you of such revisions/changes and you shall be bound by the same.


Maxis Fibre – Pre-Installation Internet

  1. You will be provided with one (1) 4G data SIM Card, Router and dongle ("Devices").
  2. The Devices must be used together and not individually at Maxis Fibre installation address. You are strictly not allowed to remove the dongle from the router or the SIM Card from the dongle without Maxis’ written permission.
  3. In the event that the Devices is lost or broken, you will be charged accordingly for the replacement and delivery of Maxis Equipment. The charge will appear in the next monthly bill.
  4. There is no guarantee of speed. Availability of service depends on Mobile Data Coverage.


Commitment Period & Duration of Service

  1. Your commitment period shall commence on the date of your successful registration of Maxis Fibre plan ("Commencement Date"). Your commitment period shall end at the expiry of 2 months from the Commencement Date or upon successful onsite installation of Maxis Fibre service at your premises, whichever is earlier ("Commitment Period"). A RM200 termination charge shall apply where you terminate the Service before the end of the Commitment Period. After the Commitment Period, the Service shall terminate automatically.


Devices Return

  1. Upon termination of the Service, you must return to us the Devices (together with its accessories) in good working condition. If you do not return the Devices or if you return the Devices but it is not in good working condition, you will be charged a fee of RM200 or such other charge as may be notified to you by Maxis from time to time. This charge does not include applicable taxes.
  2. You must make sure that any Device (together with its accessories) returned by you is in good working condition, particularly:
    1. You must ensure the Device is free from physical damage, except for fair or light wear and tear (for example, it does not have liquid damage, a physical cracks or any intentional damage).
    2. You must ensure that the Device does not have any missing, disassembled, customised, or non-original parts
  3. You agree that we have the discretion to decide whether the Device (together with its accessories) can be accepted, accepted at an additional charge or not accepted at all by us. You agree that our decision is final and that we will not entertain any queries or appeals.


Unlimited Data

  1. For data allocated with the Services(s), you acknowledge and accept:
    1. If your data usage exceeds 300GB in a month, Maxis may at its absolute discretion limit the quality of video streaming to standard definition during peak hours.
    2. The mobile internet package allocated within the Services (s) is exclusively for domestic usage only.
    3. There is no guarantee of speed. Availability of service depends on Mobile Data Coverage.


Things we may do to the Service(s)

  1. We reserve the rights at any time, without being liable to you or any third party, to interrupt, bar, suspend, restrict the Service(s) for such time as we see fit or terminate, discontinue or disconnect the Service(s) if your usage:
    1. shows excessive usage or placing unusual burdens on our Network;
    2. is for unlawful activities or for suspected fraudulent activities;
    3. is not in accordance with the Maxis Fair Usage Policy; or
    4. is for commercial/non-personal purposes.
    5. is in contravention of any of the clause in this SSTC.
