Service Specific Terms & Conditions (“SSTC”) – Maxis Unlimited Postpaid and Fibre Plan Promo

    1. This Offer: Existing subscribers of Maxis Home Fibre 100Mbps, 300Mbps, 500Mbps and 800Mbps Plan can enjoy free speed upgrade by signing up for this Offer in Maxis app.

    3. This Offer and your use of the Service(s) under this Offer is subject to:
      1. the General Terms & Conditions (“GTC”) (at https://www.maxis.com.my/terms-conditions/personal/general/maxis-consumer/ );
      2. this Service Specific Terms & Conditions (“SSTC”);
      3. the Service Specific Terms & Conditions – Maxis Home Fibre (“Maxis Home Fibre SSTC”) (at https://www.maxis.com.my/terms-conditions/personal/broadband/maxis-fibre/);
      4. Maxis Fair Usage Policy (at www.maxis.com.my/FUP); and
      5. any other applicable terms and conditions, all at www.maxis.com.my/terms-conditions/personal/.
    4. Capitalised terms herein have the same meaning as defined in the GTC.
    5. Any conflict or inconsistency between this SSTC, the Maxis Home Fibre SSTC, the GTC and Summary Terms and Conditions (“STC”), shall be construed in the following order of precedence: (a) SSTC; (b) Maxis Home Fibre SSTC; (c) GTC; and (d) STC.
    6. We reserve the rights without liability to revise this SSTC, the Offer and our pricing. Where reasonably practicable, we will give you reasonable advance notice of such changes and all previous versions of our user guides will be superseded. You accept you are responsible for regularly reviewing information on this Offer (at https://www.maxis.com.my/en/terms-conditions/products-services/home-internet/free-speed-upgrade-for-existing-maxis-home-fibre-plans) and the Service(s) (at https://www.maxis.com.my/terms-conditions/personal/), including changes to the Agreement. Your continued use of the Service(s) under the Offer (after the Effective Date of any revision/change to the terms and conditions of Agreement and/or Service(s) relevant to the Offer) shall constitute unconditional acceptance by you of such revisions/changes and you shall be bound by the same. If you do not accept such revisions/changes, you are entitled to terminate the Service(s) under this Offer and/or the use of the Service(s) under this Offer by giving us notice within 28 days from the Effective Date failing which you are assumed to have accepted the changes.
    1. The eligibility to this Offer is subject to the following criteria:
      1. Existing subscribers of Maxis Home Fibre 100Mbps, 300Mbps, 500Mbps or 800Mbps Plan who signed up before 5 October 2023; and
      2. You must not have any outstanding payments with us.
    2. The following subscribers are NOT eligible to this Offer:
      1. Subscribers which reside in areas where the network and technology infrastructure are not able to support the upgraded speed;
      2. Subscribers of any subsidized package (i.e. Pakej Rahmah);
      3. Subscribers of Maxis Family Plan;
      4. Subscribers of Hotlink Postpaid & Fibre 99 Plan; or
      5. Subscribers of Hotlink Postpaid 60 with Home Internet
    3. Notwithstanding the above, Maxis reserves the right to change the eligibility criteria for this Offer from time to time.
    1. You can only sign-up to this Offer in Maxis app by submitting the Free Speed Upgrade order in Maxis app.
    2. If you are still subject to a Commitment Period of your current Maxis Home Fibre plan, the Commitment Period shall continue if you upgrade your current Maxis Home Fibre plan under this Offer.
    3. There will not be any new Commitment Period applicable when you upgrade your current Maxis Home Fibre plan under this Offer if your Commitment Period for your current Maxis Home Fibre plan has expired.
    4. No new equipment will be provided under this Offer. Any request for new and/or replacement of any Maxis Equipment (for e.g. the router) may subject to a new Commitment Period of twenty-four (24) months.
    5. You will no longer be able to enjoy the benefits of this Offer in the event of any termination or change of plan after you signed up to this Offer. Additionally, Maxis reserves a right to impose a new commitment period if you change (i.e. upgrade or downgrade) your Maxis Home Fibre plan (which you have upgraded via this Offer).
    6. The benefits of this Offer will be suspended in the event of any suspension of your Maxis Home Fibre plan (which you have upgraded via this Offer).
    1. The applicable Charges and rate table guide for the Services under this Offer are as set out at Clause 1 above. Charges published are exclusive of applicable taxes.
    2. You are responsible for the payment of all Charges associated with this Offer (if any).
    1. In the event of termination, you will be subject to termination charges as provided under the Maxis Home Fibre SSTC.
    2. To discontinue and/or terminate the Service, you must go to any Maxis Centre.
    3. Maxis reserves the right to terminate the Service under this Offer in the instance you suspend the Service under this Offer for any period exceeding 3 consecutive months.
    1. Non-payment for the Service may result in suspension or barring of the Service until the outstanding amount is paid.
    1. We reserve the rights at any time, without being liable to you or any third party, to interrupt, bar, suspend, restrict the Service(s) under the Offer for such time as we see fit or terminate, discontinue or disconnect any of such Service(s) if your usage:
      1. shows excessive usage or placing unusual burden on our Network;
      2. is for unlawful activities or for suspected fraudulent activities;
      3. is not in accordance with the Maxis Fair Usage Policy at https://www.maxis.com.my/terms-conditions/personal/general/maxis-fair-usage-policy/ ; or
      4. is for commercial/non-personal purposes.
    1. This Offer is not exchangeable for cash.
    2. This Offer is not transferable.
