Service Specific Terms & Conditions – [Miya] (“SSTC”)

Understanding this SSTC is important because, by accessing or using Miya, you are agreeing to the terms below.

Service Specific Terms & Conditions – [Miya] (“SSTC”)

    1. The Service: Miya - available on Maxis mobile application (“App”)
    2. You: The person(s) using this service.
    3. The use of this Service is subject to you following this SSTC and the:
      1. General Terms & Conditions (“GTC”) at https://www.maxis.com.my/en/terms-conditions/general/maxis-consumer/;
      2. Service Specific Terms & Conditions – Maxis app/Hotlink app (“SSTC - Maxis app/Hotlink app”) at https://www.maxis.com.my/en/terms-conditions/manage-account/maxis-app/
      3. Maxis Fair Usage Policy at https://www.maxis.com.my/en/terms-conditions/general/maxis-fair-usage-policy/ (“FUP”); and
      4. any other applicable terms and conditions, all at https://www.maxis.com.my/en/terms-conditions/
    4. Any conflict or inconsistency between this SSTC, the SSTC – Maxis app/Hotlink app, the GTC and the STC, shall be construed in the following order of precedence: (a) SSTC; (b) SSTC – Maxis app/Hotlink app) (c) GTC; and (d) STC.
    5. We reserve the rights without liability, to revise this SSTC and the Service. If we make material revisions that negatively impact your use of the Service, we will provide you with reasonable advance notice, except in urgent situations such as preventing abuse, responding to legal requirements or addressing security and operability issues.
    6. All previous versions will be superseded by this version. You agree and accept that you are responsible for regularly reviewing information on the Service.
    7. Your continued use of the Service (after the Effective Date of this SSTC) shall constitute unconditional acceptance by you of such revisions and you shall be bound by the same. If you do not accept such revisions/, you may stop using the Service, failing which you are assumed to have accepted the revisions.
    1. The Service:
      1. is designed to provide automated responses, recommendations and assistance in areas including but not limited to customer support, billing inquiries, troubleshooting and service recommendations.
      2. is an optional, added functionality provided by Maxis to complement your access and use of our App. You are not required to use the Service in order to access or use other features made available to you on our App.
      3. may generate responses based on patterns in data and is not intended to provide professional advice of any form.
    2. All outputs generated by the Service are for general information purposes only. The Service is provided “as is” and is not subject to review or verification by Maxis and does not represent our views or endorsement. You are responsible for evaluating the responses for accuracy and suitability for your use case before acting upon them.
    1. The Service may not always provide accurate, complete, or up-to-date information.
    2. We do not guarantee that the Service will be uninterrupted, error-free, or free from harmful code.
    3. Decisions affecting your account, service plan, or financial commitments should not be based solely on the Service’s outputs.
    1. You agree to use the Service only for lawful purposes and in accordance with this SSTC and applicable laws and regulations in Malaysia.
    2. You shall not:
      1. misuse the Service for fraudulent, malicious or unlawful activities;
      2. use the Service to generate, share, or request harmful, obscene, defamatory, or discriminatory content;
      3. attempt to reverse-engineer, copy, or exploit the Service’s system;
      4. provide services that appear to originate from you (or someone else) when they actually originate from this Service;
      5. use the Service to violate anyone’s legal rights, including but not limited to privacy and/or intellectual property rights; and
      6. use the Service to develop machine learning models or related artificial intelligence technology.
    1. The Service is designed to let you upload, submit, store, send, receive, or share your content. You have no obligation to provide any content to the Service, and you are free to choose the content you want to provide. If you choose to upload or share content, you hereby confirm that you have the necessary rights to do so and that the content is lawful.
    2. By using the Service, you consent to the collection, processing, and storage of your content and data, including queries and interactions with the Service, in accordance with our Maxis Group Privacy Policy at https://www.maxis.com.my/en/privacy-notice.html.
    3. Maxis may use your data to:
      1. improve the Service’s accuracy and performance.
      2. enhance customer support and service offerings.
      3. comply with applicable laws and regulations.
    4. Maxis will handle personal data in compliance with the Personal Data Protection Act 2010 (“PDPA”) and other applicable laws of Malaysia.
    1. You may be invited to try beta, pilot, limited release, developer preview, non-production, evaluation or by a similar description, to be used in conjunction with or separate from the Service and the App, as applicable (each, a ‘Beta Service’ and collectively, the ‘Beta Services’). Beta Services are provided for evaluation and feedback purposes. You understand that the Beta Services are not generally released, and therefore, is unsupported and may contain bugs, errors and other issues. You accept the Beta Services “as is” and Maxis is not responsible for any issues related to your use of the Beta Services.
    1. All of the Service’s models, algorithms, and generated outputs (except for user-provided input) remain the property of Maxis and/or its licensors.
    2. You are granted a non-exclusive, non-transferable, revocable license to use the Service solely within the App.
    3. The Service includes content that belongs to Maxis. You may use Maxis’ content as allowed by this SSTC and the GTC, but Maxis retains intellectual property rights that we have in our content. You agree not to remove, obscure, or alter any of our branding, logos, or legal notices.
    1. The Service may provide links to content hosted on third-party platforms, such as tutorial videos on YouTube. Your access and use of such third-party content is governed by the terms and conditions of those platforms. You may not reproduce, distribute, publicly display, or otherwise use such content without permission from the respective third-party rights holder or as expressly permitted by applicable law. Maxis is not responsible for the content, availability, or your use of third-party platforms.
    1. To the fullest extent permitted by law, we disclaim all liability for any loss, damage, or injury arising from your use of the Service, whether direct, indirect, incidental, or consequential.
    2. Nothing in this SSTC excludes or limits liability where it would be unlawful to do so under Malaysian law.
    1. Maxis reserves the right to modify, discontinue, temporarily or permanently, the Service.
    2. In no event shall Maxis, its related and affiliated corporations, sponsors, agencies and representatives be liable to you or to anyone else for any loss or injury or any direct, indirect, special, exemplary, consequential damages, or any damages whatsoever, whether in contract, negligence or in tort, arising out of or in connection to the Service, or its modification or discontinuance, temporarily or permanently.
    3. Maxis is not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, unauthorized access to, or alteration of, user or member communications, or any problems or technical malfunction of our telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of e-mail or players on account of technical problems or traffic congestion on the Internet.
    4. We reserve the rights at any time without being liable to you or any third party to interrupt, bar, suspend, restrict the Service for such time as we see fit or terminate, discontinue or disconnect the Service if your usage:
      1. shows excessive usage or placing unusual burdens on the Network;
      2. is for unlawful activities or for suspected fraudulent activities;
      3. is not in accordance with FUP;
      4. is for commercial/non-personal purposes; and/or
      5. breaches this SSTC.
    5. The terms and conditions stated herein shall be governed by the Laws of Malaysia and subject to the exclusive jurisdiction of the courts of Malaysia.
