Terms & Conditions

Service Specific Terms & Conditions ("SSTC") - Maxis Zerolution360 Contract for Devices

Version [4 February 2021]

    1. The Plan: Maxis Zerolution360 (referred to as the "Zerolution360"). The Plan cannot be exchanged for cash.
    2. This Plan is not valid with any other offers and/or incentives, which have or may have been offered by Maxis under any other offers from time to time.
    3. You: Person(s) signing up for Zerolution360. You shall be responsible for payment of all charges associated with the Plan and the principal line registered under you.
    4. The use of the Service(s) under the Plan is subject to the postpaid General Terms & Conditions of Service(s) ("Agreement"), this Service Specific Terms & Conditions ("SSTC"), Maxis Fair Usage Policy and any other applicable terms and conditions, all found at www.maxis.com.my/terms-conditions/personal/general/maxis-fair-usage-policy and https://www.maxis.com.my/terms-conditions/personal/.
    5. Capitalised terms herein have the same meaning as defined in the Agreement.
    6. Any conflict or inconsistency between this SSTC and the Agreement shall be construed in the following order of precedence: (a) SSTC; and (b) Agreement. Further, the Maxis Postpaid under the Plan is subject to SSTC – Maxis Postpaid (https://www.maxis.com.my/terms-conditions/personal/postpaid/maxis-postpaid/) and the Maxis Postpaid Share 48 under the Plan is subject to SSTC – Maxis Postpaid Share 48 (https://www.maxis.com.my/terms-conditions/personal/postpaid/maxis-postpaid-share/). For clarity, if there is any conflict or inconsistency between this SSTC and the SSTC – Maxis Postpaid and/or Maxis Postpaid Share 48, this SSTC shall take precedence.
    7. We reserve the rights without liability, to revise this SSTC, Plan and our pricing. Where reasonably practicable, we will give you reasonable advance notice of such changes and all previous versions of our user guides or leaflets will be superseded. You accept you are responsible for regularly reviewing information on the Plan and Service(s) at www.maxis.com.my/tnc, including changes to the Agreement. Your continued use of the Service(s) and/or Plan (after the Effective Date of any revision/change to the terms and conditions of Services and/or Plan) shall constitute unconditional acceptance by you of such revisions/changes and you shall be bound by the same. If you do not accept such revisions/changes, you will terminate the Plan and/or the use of the Services by giving us notice within 28 days from the Effective Date failing which you are assumed to have accepted the changes.
    1. A principal line must be registered in your name and be an active account under an individual postpaid rate plan (Maxis Postpaid 98/128/158/188) offered by us. You may also sign up this Plan if you subscribe to a new Maxis Postpaid Share 48 under the same principal line/account. Any cancellation of your Maxis Postpaid 98/128/159/188 or Maxis Postpaid Share 48 will result in the termination of your Zerolution360 subscription and a penalty charge.
    2. You are ineligible for this Plan if you have any outstanding payments with us.
    3. Zerolution360 is inapplicable to you if you are a commercial user and/or bulk subscriber.
    4. You are only eligible to subscribe for (1) Zerolution360 subscription per NRIC.
    1. By accepting this Plan: you will enjoy the usage of 1 mobile device (“Device”) at the price offered by us, which is exclusive of all applicable taxes ("Zerolution360 Fee").
    2. The minimum commitment period of this Plan is twenty four (24) months from the date of acceptance of these terms and conditions ("Commitment Period"). Where you are currently on different phone/device plan and you are entitled under that plan to upgrade or switch to this Plan, where applicable, your previous phone/device offer contract is deemed terminated as at the date of execution of this Plan subject to you first paying any device remaining balance charges payable under the said previous contract.
    3. You shall not, during the Commitment Period and, in the case of sub-paragraphs (b) to (e), also during the Extended Period (hereinafter defined), if applicable:
      1. terminate your subscription to Zerolution360 Plan;
      2. terminate or suspend your Maxis mobile account or port out to another mobile service provider;
      3. have your Maxis mobile account terminated for non-payment of monthly bills;
      4. change your rate plan to a rate plan that is not eligible under this Plan. Eligible rate plans are variants of Maxis Postpaid  98, 128, 158,188 and Maxis Postpaid Share 48; and/or;
      5. change or transfer ownership of this Plan and Service(s)
    4. You acknowledge and agree that if any of the events in Clause 14 occurs, this Plan shall be deemed terminated and you shall:
      1. pay to us, as compensation for early termination, the Device remaining balance charge which shall be calculated as follows: [monthly Zerolution360 Fee] x [the remaining months of the Commitment Period]; and
      2. return your Device in good working order to us immediately;
    5. The payment of the Device remaining balance charge is without prejudice to the collection of all monies owing to us by you in accordance with your account up to the time of early termination. You will receive a final statement of account which will be due and payable by you to us immediately upon receipt. All outstanding amounts due and owing to us shall be subject to all applicable taxes.
    6. Device advance payment may be applicable subject to your eligibility. If we collect device advance payment from you, such amount will be refunded to you by way of rebate on your monthly bill over a 12-month period. This Plan must be in active status for you to be able to receive the said refund of Device Advance Payment from us.
    7. You agree we have the rights to block the IMEI of the Device if you are:
      1. suspected of fraud or found to have committed fraud;
      2. after signing up to this Plan, you fail to make full payment of any amount due within 14 days of the statement due date;
      3. you have reported to us that the Device is missing or has been stolen and have requested us to block the IMEI of the Device.
    8. You are responsible for any loss, theft or damage to the Device at all times and shall continue to pay the Zerolution360 Fee for the Commitment Period and Extended Period, if applicable, notwithstanding that the Device is lost or damaged.
    9. You accept and acknowledge you will be liable for the Plan, Commitment Period, Device, payment and charges, this services specific terms and conditions and the General Terms and Conditions.
    10. You accept and acknowledge that the Device title and ownership does not belong to you. The Device is provided under this Plan to you and you are accountable for the use and safety of the Device. Nothing in this SSTC shall be construed as transferring the title or ownership of the Device to you unless otherwise expressly stated. You shall not directly or indirectly give or allow another person to give any interest in or lien over the Device. You shall promptly, at your own costs and expenses, take all such actions as may be necessary to duly discharge or eliminate any such liens upon obtaining actual knowledge thereof.
    1. The Device is to be returned to us in good working order upon the earlier of the following:
      1. the expiry of the Commitment Period; or
      2. early termination of this Plan.
    2. In the event that the Device is not return to us:-
      1. upon the expiry of the Commitment Period, clause 24 shall apply;
      2. upon early termination of the Plan, you shall be liable to pay us a non-return fee for the Device to be determined by us based on the Device model and its residual value. Upon payment of the non-return fee for the Device by you to us, the Device shall be regarded as belonging to you. The non-return fee shall be in addition to the Device remaining balance charge as compensation for early termination in clause 15.
    3. In the event that the Device is not return on the expiry of the Commitment Period, this Plan shall continue to be valid and effective on a month to month basis up to 6 months (“Extended Period”) wherein the monthly Zerolution360 Fee shall continue to be payable to us. The monthly Zerolution360 Fee payable during the Extended Period may be different from the monthly Zerolution360 Fee during the Commitment Period and is subject to adjustment by us depending on the Device model as stated in the Registration Form. This Plan shall then terminate on the expiry of the Extended Period.
    4. Within the Extended Period:
      1. If you wish to terminate the Plan and you return the Device to us in good working order, this Plan shall expire and you shall not be liable to a non-return fee for the Device.
      2. If you wish to terminate the Plan or when the Plan is terminated but you fail to return the Device to us on termination of the Plan, you shall be liable to pay us a non-return fee for the Device to be determined by us based on the Device Model and its residual value.
    5. For the avoidance of doubt, notwithstanding anything to the contrary, we are not obliged to accept the Device should you seek to return the Device after the Extended Period.  
    6. In any event if the Device is returned to us but the same is not in good working condition, 
      1. we shall be entitled to charge you for any cost of repair to make good the Device and you shall pay the same unless the cost of repair is partially or fully covered under the Maxis Safe Device (MSD) plan subscribed by you. Any portion of the cost not covered under the Maxis Safe Device (MSD) plan shall be borne by you;
      2. Notwithstanding sub-paragraph (a), we may, at our sole discretion, decide not to accept the return of the Device irrespective of whether you have a Maxis Safe Device (MSD) plan and irrespective of whether you wish to pay for the cost of repair, where we determine that the condition of the Device is not acceptable to us. In such instance, you will be charged the non-return fee for the Device to be determined by us based on the Device model and its residual value. Upon payment of the non-return fee for the Device by you to us, the Device shall be regarded as belonging to you.
    7. The payment of the non-return fee (if any) by you is without prejudice to any other charges and fees due to us including charges under the Maxis Postpaid plan and Device remaining balance charges. It shall be your obligation to return the Device in accordance with the terms and conditions stated herein.
    1. Subject to clauses 30 and 31 below, you are entitled to upgrade to a new Device offered by us from time to time.
    2. When you choose to exercise your upgrade under the Upgrade Plan, you will be charged an upgrade fee which is dependent on the time period upon which you upgrade.
    3. In order to be eligible for the Upgrade Plan, you must:
      1.  fulfill at least 12 months of the Plan in order for us to waive-off the remaining months of your Zerolution360 Fee under the Plan;
      2. return your Device in “good working condition” as stipulated in the Device Return Guidelines (for a device upgrade); and
      3. pay the Upgrade Fee upon signing up for the Upgrade Plan.
    4. Once you exercise your right to upgrade your Device under this Upgrade Plan, your minimum Commitment Period of twenty four (24) months restarts from the date of upgrade.
    5. You shall not, during the new Commitment Period:
      1.  terminate your Upgrade Plan;
      2. terminate or suspend your Maxis mobile account or port out to another mobile service provider;
      3. have your Maxis mobile account terminated for non-payment of monthly bills;
      4. change rate plan to a rate plan that is not eligible under the Plan(s); and/or
      5. Change or transfer ownership of this Plan and Service(s).
    1. A minimum 3-month waiting period is applicable to you for this Plan if you are:
      1. a new customer of Maxis; or
      2. an existing customer of Maxis eligible to take up more than 1 device contract under the same Malaysian identity card number or passport number, each device contract must be 3 months apart.
    1. We will not be responsible to replace the Device or any part thereof that is lost, stolen, damaged or defective (where such defect is not a manufacturer defect). You shall be responsible for the repair and maintenance of your Device. Repairs shall be subject to the applicable warranty issued by the manufacturer
