NeXT M1 & X1 Warranty - Terms and Conditions

Definition

“Mobile Device” herein shall have the same meaning as defined in Maxis’ General Terms & Conditions and shall refer to the NeXT by Maxis device (X1) when used in the context of this warranty.

Summary of Coverage

The purchase of the Mobile Device entitles you to coverage as below:

  1. Twenty four (24) months Mobile Device manufacturer’s warranty (including the non-removable Battery).
  2. First twelve (12) months accessories manufacturer’s warranty for the 3-pin plug, USB cable and Earphone limited to six (6) claims for any of the accessories.
  1. An out of warranty device replacement discount at 50% off Recommended Retail Price (RRP) limited to one (1) claim per Mobile Device purchased. Any claims for out of warranty Mobile Devices replaced at the discount of 50% off RRP are subject to the following conditions:
    1. This claim is only applicable for damages not covered under warranty within the 24 months Mobile Device warranty coverage;
    2. To be eligible for this claim, you must return your damaged Mobile Device to receive a replacement Mobile Device. This replacement is only applicable for Mobile Devices and not accessories;
    3. The replaced Mobile Device will have a warranty of 12 months from the date of 50% off RRP replacement purchase. Any prior warranty tied to the damaged Mobile Device is non-transferrable, except for accessories;
    4. Your accessory warranty coverage will continue from the warranty of the first Mobile Device purchased.
  1. An additional cracked screen protection (“Cracked Screen Protection”) due to accidental damage limited to one (1) claim only for the first six (6) months subject to subscription of a twenty four (24) months contract rate plan with the Mobile Device.

Limited Warranty Statement

In order to be eligible for the Limited Warranty:-

  1. you may be required to produce your original receipt or proof of purchase stating the date of purchase when you are sending your Mobile Device in for repairs; and
  2. the internal data of your Mobile Device must comply with the original receipt or proof of purchase.

This Limited Warranty is subject to the following terms and conditions:

  1. This warranty applied to the Mobile Device commences from the date of purchase. Different warranty period applies to different parts of the Mobile Device which are as follows:-
    1. twenty four (24) months for the Handset/Host Mobile Device which are:-
      1. first time claim for a 1 to 1 replacement (one-time only); and
      2. subsequent claims shall be on repair basis only.
    2. first twelve (12) months accessories manufacturer’s warranty for the 3-pin plug, USB cable and Earphone with a 1 to 1 replacement limited to six (6) claims for any of the accessories; and
    3. additional warranty for the first six (6) months for Cracked Screen Protection due to accidental damage limited to one (1) claim only for Customer who signed up for a twenty four (24) months contract rate plan with the Mobile Device. (sub-paragraph (a) to (c) above shall be collectively referred to as the “Limited Warranty”).
  2. You are also entitled to an out of warranty device replacement at 50% off the RRP which is limited to one (1) claim per Mobile Device purchased. Any claims for out of warranty Mobile Devices replaced at the discount of 50% off RRP are subject to the following conditions:
    1. This claim is only applicable for damages not covered under warranty within the 24 months Mobile Device warranty coverage;
    2. To be eligible for this claim, you must return your damaged Mobile Device to receive a replacement Mobile Device. This replacement is only applicable for Mobile Devices and not accessories;
    3. The replaced Mobile Device will have a warranty of 12 months from the date of 50% off RRP replacement purchase. Any prior warranty tied to the damaged Mobile Device is non-transferrable, except for accessories;
  1. Your accessory warranty coverage will continue from the warranty of the first Mobile Device purchased.
  2. Dead on arrival Mobile Device must be returned within seven (7) days from the date of purchase at your own cost and expense.
  3. We recommend that you keep the original packaging of the Mobile Device in a good condition in the event the Mobile Device may need to be returned to us.
  4. Although we make every effort to replace with the same make, model and/or color, it may not always be possible and we reserve the right to offer you alternative options available at the time which will be discussed with you prior to completion of the replacement.
  5. All repaired/replaced Mobile Device (parts included) and accessories shall receive a further thirty (30) days warranty extension from the date of completion of the warranty claim service and not from the point of actual collection. This applies to Mobile Device/accessories where the service completion date is after the Limited Warranty expiry date. This extension is only applicable once.
  6. Charges are applicable for damages not covered under the Limited Warranty.
  7. You are responsible to send the defective Mobile Device to selected Maxis Centers and Maxis Exclusive Partners, during its working days excluding national and regional holidays, at your own expense.
  8. We strongly advise and recommend that you remove your SIM Card and disable all security features before handing over the Mobile Device to the selected Maxis Centers and Maxis Exclusive Partners. We will not be held responsible for any loss of SIM Card. We and our selected Maxis Centers and Maxis Exclusive Partners accept no liability in the event a SIM card is included within the Mobile Device and charges are then incurred. You agree that you will continue to be responsible for such charges.
  9. You are also advised to back-up your data, complete a factory reset to delete personal information and power down the Mobile Device before handing over the Mobile Device to the selected Maxis Centers and Maxis Exclusive Partners. You agree to release us and our selected Maxis Centers and Maxis Exclusive Partners from all and any claims, losses or damages with respect to any data and information stored or contained in the Mobile Device or on any media used in conjunction with the Mobile Device (whether in the form of personal data and details, SMS', photos, games, songs or any other data or information) which may be deleted or erased as part of the repair process. Maxis and its selected Maxis Centers and Maxis Exclusive Partners accept neither responsibility nor liability for and in relation to the security, protection, confidentiality or use of such data and information.
  10. Any defect arising due to misuse of the Mobile Device, damages due to liquid ingress, or physical abuse, or normal wear and tear will not be covered by this Limited Warranty. Plastic components like front and back cover plus rubber component like key pads and antenna will not be covered under the Limited Warranty.
  1. The Limited Warranty shall be void if:
    1. the warranty seal on the Mobile Device is broken;
    2. the Mobile Device is tampered with, altered or repaired by unauthorized persons/ repair center / agency;
    3. the serial number of the Mobile Device is deleted, defaced or altered rendering it difficult to identify the instrument;
    4. you fail to properly adhere to the instructions for the installation process and use;
    5. the Mobile Device is damaged by accidents, lightning or any other acts of God; or
    6. the Mobile Device has been exposed to moisture, to dampness or to extreme thermal or

This Limited Warranty does not include user manuals or any third party software, settings, content, data or links, whether included/downloaded/inserted in the Mobile Device, whether included during installment, assembly, shipping or at any other time in the delivery chain or otherwise and in any way acquired by you.
  2. There are no customer serviceable parts inside the Mobile Device and hence the same should not be opened by you or any person / agency other than the authorized service personnel / agency.
  3. Whether defective items or components are to be replaced or repaired shall be at the sole and absolute discretion of Maxis. In case of replacement of any parts of the Mobile Device and/or accessories, you agree that the ownership of the defective part(s) removed from the Mobile Device and/or defective accessories shall be transferred to and become the property of Maxis.
  4. This Limited Warranty is your sole and exclusive remedy against Maxis and sets out Maxis' sole and exclusive liability in respect of defects of your Mobile Device.
  5. This Limited Warranty replaces all other NeXT by Maxis warranties and liabilities of the Mobile Device, whether oral, written, (non-mandatory) statutory, contractual, in tort or otherwise, including, without limitation, and where permitted by applicable law, any implied conditions, warranties or other terms as to satisfactory quality or fitness for purpose. To the extent permitted by applicable law(s) Maxis does not assume any liability for loss of or damage to or corruption of data, for any loss of profit, loss of use of the Mobile Device or functionality, loss of business, loss of contracts, loss of revenues or loss of anticipated savings, increased costs or expenses or for any indirect loss or damage, consequential loss or damage or special loss or damage. To the extent permitted by applicable law, Maxis’ liability shall be limited to the purchase value of the Mobile Device.
  6. We reserve the rights without liability, to revise this Limited Warranty. Where reasonably practicable, we will give you reasonable advance notice of such changes and all previous versions of our user guides or leaflets will be superseded. You accept you are responsible for regularly reviewing information on the Mobile Device and Service(s) at www.maxis.com.my/tnc), including changes to the Agreement. Your continued use of the Mobile Device and Service(s) after the Effective Date of any revision/change to the terms and conditions of this Limited Warranty and Services shall constitute unconditional acceptance by you of such revisions/changes and you shall be bound by the same.
