Service Specific Terms & Conditions ("SSTC") - Mobile Internet Packages

    1. The Service: Mobile Internet Service (“MI Service”)
    2. You: Person(s) signing up for the Service.
    3. The MI Service is a service provided by us which allows you to connect to and access the Internet, both via mobile devices or personal computers
    4. The use of the MI Service are subject to  the General Terms & Conditions (“GTC”),  Service Specific Terms & Conditions (“SSTC”), Maxis Fair Usage Policy (www.maxis.com.my/FUP) and any other applicable terms and conditions, all at (www.maxis.com.my/terms-conditions/personal/)
    5. Capitalised terms herein have the same meaning as defined in the GTC.
    6. Any conflict or inconsistency between this SSTC, the GTC and Summary Terms and Conditions (“STC”), shall be construed in the following order of precedence: (a) SSTC; (b) GTC; and (c) STC.
    7. We reserve the rights without liability, to revise this SSTC, Plan(s) and our pricing. Where reasonably practicable, we will give you reasonable advance notice of such changes and all previous versions of our user guides or leaflets will be superseded. You accept you are responsible for regularly reviewing information on the Plan(s) and Service(s) at www.maxis.com.my/tnc), changes to the Agreement. Your continued use of the Service(s) and/or Plan(s) (after the Effective Date of any revision/change to the terms and conditions of Services and/or Plan(s)) shall constitute unconditional acceptance by you of such revisions/changes and you shall be bound by the same. If you do not accept such revisions/changes, you will terminate the Plan(s) and/or the use of the Services by giving us notice within 28 days from the Effective Date failing which you are assumed to have accepted the changes.
    1. You must be 18 years old and above and a Maxis postpaid service subscriber to use, preview and/or subscribe to the MI Service.
    2. You are ineligible for MI Service if you have any outstanding payments with us.
    3. This Product is not applicable to you if you are a commercial user and/or bulk subscriber.
    1. You can subscribe for the MI Service via UMB , Mobile Application (MyMaxisApp), Maxis Online Account (MOA), WAP Portal , or by calling our customer service (123) (applicable for postpaid customers only).
    2. Once you have subscribed to the MI Service, you will have to wait for an SMS confirming activation of the MI Service before using the MI Service.
    1. As of 2nd July 2014, all the available postpaid data packages and applicable rates are capped based on the time/usage (quota entitlement), which are set out in the attached MI Service Appendix.
    2. As of 2nd July 2014, the postpaid data packages under the MI Service Packages terms and conditions are referred to as follows:
      1. The Postpaid 1 Day Pass of 100MB and 1 Day Pass of 500MB are categorised and referred to as “Postpaid One-time Passes” with pass validity of 24 hours.
      2. The Monthly Pass 100MB, Monthly Pass 200MB, Monthly Pass 500MB and Monthly Pass 1.0GB, as well as SurfMore’s 1GB & 2GB Quota Upgrades are referred to as “ Postpaid Monthly Renewable Passes”
      3. The Postpaid Quota Upgrade of 50MB, 100MB, 200MB, 500MB and 1.0GB are referred to as “Postpaid  One-time Passes” with pass validity of 31 days or until the end of bill cycle, whichever comes first.
    3. The Postpaid One-time Passes [in (c)] are only available to Customers who subscribe for Monthly Renewable Passes. Customers who subscribed for Monthly Renewable Passes may, at any one time purchase (in addition to the monthly pass already subscribed for) a Postpaid One-time Passes concurrently.
    4. Subject to respective passes’ terms and conditions, you may purchase any number and/or combination of the Postpaid One-time Passes. However, if you wish to purchase another Postpaid One-time pass (which is the same as the one you have just purchased), you can only do so after thirty (30) minutes lapse from the first purchase.
    5. We may charge you (customers) for any previous Services or usages consumed by you, that may not have been charged in your previous bills.
    1. The rates outlined in Table I – Postpaid Mobile Internet rates of the Appendix do not account for usages while on an overseas roaming network. For international roaming data usages, you will be subject to the rates as stipulated at https://www.maxis.com.my/lifestyle/roaming-idd/international-roaming/
    2. Whilst you are on data roaming, each data session is split evenly on the home network and the overseas roaming network. Hence, you will incur data charges for both the local portion within the Maxis network and again for the same usages on the overseas roaming network.
    1. The order of utilization for the volume entitlement shall be as follows:
      1. For Postpaid One-time Passes, whichever expires first shall have its volume entitlement exhausted first;
      2. Postpaid Monthly Renewable Passes/packages (which was subscribed for). The volume entitlement of item (a) shall be exhausted first, followed item (b).If you are not subscribed to a data plan (i.e. you are charged based on general pay-per-use rates) and wish to purchase the Postpaid Monthly Renewable Passes, the charges for the Postpaid Monthly Renewable Pass will be pro-rated based on the remaining days of the bill cycle, starting from the effective date of the new plan. The volume entitlement of the Postpaid Monthly Renewable Pass you subscribed to in the middle of a bill cycle will be given in full.
    1. You may subscribe to the "Share 'n' Surf Service", which allows you to own up to six (6) SIM Cards on one Maxis line i.e. one (1) primary SIM Card and five (5) secondary SIM Cards. You may be required to change your existing SIM Card(s) for new ones.
    2. The total data allocation subscribed for under any of the SIM Cards will be shared among all the SIM Cards on the same Maxis line.
    3. The Share ‘n’ Surf Service is only available for customers subscribing to the Postpaid Renewable Monthly Passes above 2GB. If you subscribed to a Postpaid Monthly Renewable Pass of 2GB or less and have subscribed for the Share ‘n’ Surf Service, Maxis reserves the right to change your existing subscription of the Postpaid Monthly Renewable Pass of 2GB or less to such Postpaid Monthly Renewable Pass, for you to continue with your subscription of the Share ‘n’ Surf Service. You agree to pay all the applicable charges thereto.
    4. As of 3rd September 2013, the Share 'n' Surf Service and the applicable rates are set out in the table in the attached Appendix.
    1. At any one time, only one of the SIM Cards can be an active profile, meaning the only SIM Card which has access to Maxis’voice calls and SMS services. SMS notifications on data usage will be channelled to the SIM Card of such active profile. All SIM Cards which are not under the active profile can only make outgoing calls and SMS’ which will be chargeable based on your rate plan subscribed to.
    2. You must ensure that you and users of the SIM Cards under your line abide by all conditions, restrictions and notifications issued by Maxis in relation to the Share ‘n’ Surf Service. You are responsible for your use or use by others and the usages of all SIM Cards under your line. 
    1. We reserve the rights at any time, without being liable to you or any third party, to interrupt, bar, suspend, restrict the Service(s) for such time as we see fit or terminate, discontinue or disconnect the Service(s) if your usage:
      1. shows excessive usage or placing unusual burdens on our Network;
      2. is for unlawful activities or for suspected fraudulent activities;
      3. is not in accordance with the Maxis Fair Usage Policy (at www.maxis.com.my/FUP); or 
      4. is for commercial/non-personal purposes.
      5. is to prevent network congestion, traffic from peer-to-peer software/applications (such as BitTorrent, eDonkey, Gnutella) or file sharing software (such as Limewire) are blocked from the hours of 6am to 12am (Midnight) every day.
    2. Without limiting the generality of the Maxis Fair Usage Policy, if you are on the legacy Unlimited Data plan, you will be subjected to a fair usage data volume total of 10GB per month for the amount of data transmitted (total upload and download usage). The speed for usage exceeding the 10GB threshold will be throttled. Such throttled speeds will be at a maximum 128kbps.
    3. You shall abide by all conditions, restrictions and notifications issued by us in relation to the MI Service and Share ‘n’ Surf Service. If we are of the view that there has been a contravention of these terms and conditions, we reserve the rights to terminate and/or suspend your access and use of the MI Service and/ or Share ‘n’ Surf Service.
    1. As a customer subscribing for MI Service, the following methods enable you to be informed of the status of usage for the MI Service:
      SMS Notifications
      1. You will receive a SMS notification to inform you that your usage (as at the time set out in the SMS notification ("Time Stamp"), not the time of your receipt of the SMS notification):
        1. has reached 60% of the volume quota for the data package which you have subscribed for ("60% Notification"); and/or
        2. has exhausted the entire volume quota for the data package which you have subscribed for ("100% Notification").
        3.  if you have exhausted the entire volume quota for the data package which you have subscribed for before your receipt of the 60% Notification, you will only receive the 100% Notification.
      2. As of 2nd July 2014, you will also receive the SMS notifications below at the following intervals to inform you that your Postpaid pay-per-use usage (as at the Time Stamp) has reached:
        1. 1KB;
        2. 60% of 1st 50MB block;
        3. 60% of 2nd 50MB block;
        4. 60% of 3rd 50MB block;
        5. 60% of 4th 50MB block;
        6. 60% of 5th 50MB block;
        7. 100% of 5th 50MB block.
      3. Without limitation to these terms and conditions, you acknowledge and agree: (i) the SMS notification is for your convenience only; (ii) the SMS notification received from us may be delayed; and (iii) The information in the SMS notification is system generated, based on the records as at the Time Stamp, not the time of your receipt of the SMS notification and the information may not be up to date at the time you received the SMS notification; and (iv) we are not liable for any error or omission of information in the or non-receipt of the SMS notification and shall not be liable to you for any damages, loss, expenses, claims, demands or costs of any kind arising from such circumstances.

        Check Status Function
        1. You may check your volume quota usage for the MI Service via (UMB) by selecting the 'Check Status' option in the Mobile Internet menu; MyMaxis App (Mobile Application) by logging in using your Maxis Mobile ID; or Maxis' WAP Portal at m.maxis.com.my/mi ("Check Status Function").
        2. You acknowledge and agree: (i) the Check Status Function is for your convenience only; (ii) the receipt of the information using the Check Status Function may be delayed; (iii) the information received using the Check Status Function is system generated, based on the records as at the Time Stamp, not the time of your receipt of the said information and it may not be up to date at the time you received it; and (iv) we are not responsible for any error or omission of information from your use of or non-receipt of the Check Status Function and shall not be liable to you for any damages, loss, expenses, claims, demands or cost of any kind arising from such circumstances;
    1. The MI Service and Share ‘n’ Surf Service can be used on all SIM-based devices. You are solely responsible to ensure that the Mobile Phone or device used by you is compatible and enables you to use the MI Service and Share ‘n’ Surf Service.
    2. You continue to be liable for any and all charges incurred in connection with the MI Service and Share 'n' Surf Service even if you are unable to use the MI Service and Share 'n' Surf Service purchased or subscribed to. If you are unsure whether your Mobile Phone or device is compatible for use of the MI Serviceand Share 'n' Surf Service, please refer to your mobile phone or device handbook or check with the manufacturer of your mobile phone or device. Maxis shall not be liable and/ or responsible if you be unable to use the MI Service or Share 'n' Surf Service as a result of the make or model or functionality limitations of your Mobile Phone or device.
    1. Subject to our GTC, a principal line holder may at any time terminate the MI Service or Share 'n' Surf Service as follows:
      1. By calling our customer care line at 1-800-82-1123 or dial 123 from your mobile;
      2. By walking into our Maxis Centres listed on www.maxis.com.my; or
      3. By writing in to customercare@maxis.com.my
