Service Specific Terms & Conditions (“SSTC”) – Maxis Fibre Rebate Offer for Maxis Postpaid Customer

• General

  1. This Offer: Sign up for Maxis Fibre 30Mbps, 100Mbps, 300Mbps, 500Mbps or 800Mbps Plan to enjoy rebates on the Charges of your monthly Maxis Fibre bill for a duration of six (6) months (“Rebate”). Please note that:
     
     • The Rebate under this Offer:
       

  Maxis Fibre Plan	Rebate on Monthly Charges
  Maxis Fibre 30Mbps Plan	RM20/month rebate for 6 months
  Maxis Fibre 100Mbps Plan	RM30/month rebate for 6 months
  Maxis Fibre 300Mbps Plan
  Maxis Fibre 500Mbps Plan
  Maxis Fibre 800Mbps Plan

  • 2. Rebate will commence within the first (1st) month after the successful installation of your Maxis Fibre Service; and
       
    3. Each Maxis Fibre Plan is subject to a 24 months’ commitment period (inclusive of rebate duration), as per the Service Specific Terms & Conditions – Maxis Fibre.

  3. Offer Availability Period: 6th September 2023 to 5th November 2023
  4. This Offer and your use of the Service(s) under this Offer is subject to:
     1. the General Terms & Conditions (“GTC”) (at https://www.maxis.com.my/terms-conditions/personal/general/maxis-consumer/ );
     2. this Service Specific Terms & Conditions (“SSTC”);
        
     3. the Service Specific Terms & Conditions – Maxis Fibre (“Maxis Fibre SSTC”) (at https://www.maxis.com.my/terms-conditions/personal/broadband/maxis-fibre/);
     4. Maxis Fair Usage Policy (at www.maxis.com.my/FUP); and
     5. any other applicable terms and conditions, all at www.maxis.com.my/terms-conditions/personal/.
  5. Capitalised terms herein have the same meaning as defined in the GTC.
     
  6. Any conflict or inconsistency between this SSTC, the Maxis Fibre SSTC, the GTC and Summary Terms and Conditions (“STC”), shall be construed in the following order of precedence: (a) SSTC; (b) Maxis Fibre SSTC; (c) GTC; and (d) STC.
  7. We reserve the rights without liability to revise this SSTC, the Offer and our pricing. Where reasonably practicable, we will give you reasonable advance notice of such changes and all previous versions of our user guides or leaflets will be superseded. You accept you are responsible for regularly reviewing information on this Offer (at https://www.maxis.com.my/en/terms-conditions/products-services/home-internet/maxis-fibre-rebate-offer-for-maxis-postpaid-customers) and the Service(s) (at https://www.maxis.com.my/terms-conditions/personal/), including changes to the Agreement. Your continued use of the Service(s) under the Offer (after the Effective Date of any revision/change to the terms and conditions of Agreement and/or Service(s) relevant to the Offer) shall constitute unconditional acceptance by you of such revisions/changes and you shall be bound by the same. If you do not accept such revisions/changes, you are entitled to terminate the Service(s) under this Offer and/or the use of the Service(s) under this Offer by giving us notice within 28 days from the Effective Date failing which you are assumed to have accepted the changes.
     

• Eligibility

  8. The eligibility to this Offer is subject to the following criteria:
     • you are an existing Maxis Postpaid customer;
       
     • you have received an email from us on this Offer and you have completed the registration for the Maxis Fibre Plan (including providing the necessary details for such registration) via the link provided in that email;
       
     • you are currently NOT an existing Maxis Fibre customer;
       
     • you must not have any outstanding payments with us; and
       
     • you are not a commercial user and/or bulk subscriber.
  9. Notwithstanding the above, Maxis reserves the right to change the eligibility criteria for this Offer from time to time.
     

• Charges

  10. The applicable Charges and rate table guide for the Services under this Offer are as set out on our official website at https://www.maxis.com.my/broadband/maxis-fibre/. Charges published are exclusive of applicable taxes.
  11. You are responsible for the payment of all Charges associated with this Offer (if any).
      

• Rebate and Rebate Period

  12. After the successful installation of the Maxis Fibre Service (signed up under this Offer) at your Premise, Maxis will assign the Rebate to your monthly bills of your Maxis Fibre Plan, as follows:
      
      • the Rebate will commence within the first (1st) month after the successful installation of the Maxis Fibre Service, on such date as determined by Maxis (“Rebate Assignment Date”) and the applicable Rebate will be spread over the next six (6) months’ period (“Rebate Period”).
        Example:
        If the Rebate Assignment Date is on the 15th day of the first (1st) month after the successful installation of the Maxis Fibre Service:

  1st	Pro-rated from 15th to the last day of the month	Charges after deducting the applicable pro-rated Rebate
  2nd to 6th	Full Rebate	Charges after deducting the applicable Rebate
  7th	Pro-rated from 1st to 14th day of the month	Charges after deducting the applicable pro-rated Rebate
  8th onwards	No Rebate	Full Charge

  • 2. After the expiry of the Rebate Period, the full monthly Charges for the respective Maxis Fibre Plan will apply
       

• Termination

  13. You shall NOT during the Rebate Period:
      • terminate your Maxis Fibre Plan;
        
      • suspend your Maxis Fibre Plan;
        
      • have your Maxis Fibre Plan terminated for non-payment of monthly bills;
        
      • change or transfer ownership of your Maxis Fibre Plan to another person; or
        
      • downgrade your Maxis Fibre Plan.
        
  14. If any of the events in Clause 13 occurs, you will no longer be entitled to the Rebate under this Offer and will be subject to termination charge as provided under the Maxis Fibre SSTC.
      
  15. To discontinue and/or terminate the Service, you must go to any Maxis Centre.
      
  16. Maxis reserves the right to terminate the Service under this Offer in the instance you suspend the Service under this Offer for any period exceeding 3 consecutive months and the consequences as per Clause 14 (as the case may be) may apply if such termination occurs during the Rebate Period.
      

• Deposit & Billing

  17. A deposit of RM300 for the Maxis Fibre Plan is chargeable for non-Malaysians subscribing for the Offer.
      
  18. Non-payment for the Service may result in suspension or barring of the Service until the outstanding amount is paid.
      

• Things we may do to the Service(s)

  19. We reserve the rights at any time, without being liable to you or any third party, to interrupt, bar, suspend, restrict the Service(s) under the Offer for such time as we see fit or terminate, discontinue or disconnect any of such Service(s) if your usage:
      
      • shows excessive usage or placing unusual burden on our Network;
        
      • is for unlawful activities or for suspected fraudulent activities;
        
      • is not in accordance with the Maxis Fair Usage Policy at https://www.maxis.com.my/terms-conditions/personal/general/maxis-fair-usage-policy/; or
      • is for commercial/non-personal purposes.
        

• Additional Features & Requirements

  20. This Offer is not exchangeable for cash.
  21. This Offer is not transferable.
  22. This Offer is not applicable to Maxis employees (permanent or contract).
