Service Specific Terms & Conditions (“SSTC”) – Samsung TV Trade-In Program Promotion

    1. This Promotion: Trade-in your old TV with Samsung (as defined below) under the Samsung TV Trade-In Program (“Program”) when you subscribe to a Samsung TV under Home Zerolution.
    2. You: Person(s) participating in this Promotion.
    3. Promotion Period: 15 December 2023 – 30 November 2024.
    4. By participating in this Promotion, you agree to be bound by our General Terms and Conditions (“GTC”) at https://www.maxis.com.my/en/terms-conditions/general/maxis-consumer/, Summary Terms and Conditions (“STC”) and this Service Specific Terms & Conditions – Samsung TV Trade-In Program Promotion (“SSTC”), which may be updated by Maxis from time to time.
    5. Capitalised terms herein have the same meaning as defined in the GTC.
    6. Any conflict or inconsistency between this SSTC, the GTC and STC, shall be construed in the following order of precedence: (a) SSTC; (b) GTC; and (c) STC.
    7. We reserve the rights without liability, to revise this SSTC and the Promotion. Where reasonably practicable, we will give you reasonable advance notice of such changes and all previous versions of our user guides or leaflets will be superseded. You accept you are responsible for regularly reviewing information on this Promotion (at https://www.maxis.com.my/en/terms-conditions/promotions/campaign/trade-in-promo/maxis-samsung-tv-trade-in-program) including changes to the Agreement. Your continued participation of this Promotion (after the Effective Date of any revision/change to the terms and conditions of Agreement and/or this Promotion) shall constitute unconditional acceptance by you of such revisions/changes and you shall be bound by the same. If you do not accept such revisions/changes, you are entitled to terminate your participation of this Promotion by giving us notice within 28 days from the Effective Date failing which you are assumed to have accepted the changes.
    1. Samsung TV Trade-In Program is a program offered and provided by Samsung Malaysia Electronics (SME) Sdn. Bhd (Registration No. 200301026766 (629186-D)) (“Samsung”).
    2. The information of the Program which is made available by Maxis (including via Maxis Store) to you is supplied by Samsung. You understand and accept that we have not necessarily checked such information provided by Samsung and we make no representation and warranty about Program that you might be able to obtain elsewhere.
    3. This is a non-transferable Program, whether by operation of law or otherwise, either to any other person, entity or account.
    4. We do not warrant the continuity, uninterruptible and/or error-free of the buy-back and trade-in service operated and managed by Samsung under the Program and we expressly disclaim any representations or warranties of title, non-infringement, merchantability, usage, fitness or technical function in relation to the Program.
    5. Maxis reserves the right to suspend, terminate, cancel or vary this Promotion at its sole discretion anytime without any prior notice.
    6. You are required to register to the Program with Samsung (either through Samsung or its appointed agents/vendors) separately and such registration is strictly between you and Samsung; Maxis will not be liable for any claims and disputes arising from Program and/or the registration of the Program.
    1. The Promotion is open to all Maxis’ subscribers who are: -
      1. citizens or permanent residents of Malaysia;
      2. at least 18 years of age;
      3. existing subscriber for any Maxis Fibre; and
      4. subscribe to a Samsung TV under Home Zerolution
    2. You are not eligible to participate in the Promotion if you have any outstanding payments with us.
    3. You can only trade-in one (1) unit of TV for every Samsung TV that you subscribed under Home Zerolution.
    4. Any TV that is currently within any commitment period/ contract with Maxis or Maxis’ lease plans (for e.g. Zerolution/ Maxis Device Contract) is not eligible for in the Program.
    5. Any TV which you wish to trade-in under the Program shall fulfil the criteria and requirements in the Appendix (“Eligible Device”). Please note that Samsung may change any of such criteria and requirements at its discretion, and you acknowledge and agree that Maxis shall not be responsible for any such changes made by Samsung.
    6. The collection address of the Eligible Device must:
      1. be the same as the delivery address for the Samsung TV which you subscribed under Home Zerolution; and
      2. not be located in  Pulau Ketam, Tioman, Langkawi and Pangkor.
    1. By participating in the Program, you represent and agree that you are authorized to trade in your Eligible Device to Samsung and that you have the ownership, title and interest in the Eligible Device submitted under the Program. Upon Samsung accepting the Eligible Device, title of ownership in such Eligible Device transfers to Samsung and you shall disclaim any further right, title or interest in and to the Eligible Device or any items contained therein.
    2. Before submitting the Eligible Device to Samsung, you must back-up your personal data and anything else you want to keep (collectively, ‘‘Content”) and reset your Eligible Device to its factory settings.
    3. Data recovery or data backup is not a part of the service under the Program, and we accept no responsibility or liability for any lost of Content, files or data in your traded-in Eligible Device. You hereby expressly agree to indemnity Maxis and Maxis’ directors, officers, employees, affiliates or agents from and against any claims brought against any of them in connection with the performance of the Program and release us from any claims, losses or damages that may arise with respect to it.
    1. The trade-in quote and the final agreed trade-in value may vary depending on the final inspection of your Eligible Device at Samsung’s appointed vendor’s warehouse and Samsung’s appointed vendor’s decision shall be the final decision.
    2. Should you change your mind after you acknowledge the trade-in value and get your Eligible Device collected (but prior to payment of the trade-in value to you by Samsung’s appointed vendor), you may reach out to Samsung’s appointed vendor via email at info@mttsolutions.com.my, or send a message via WhatsApp to 012- 9696 305. Kindly note that a RM150 transportation fee will be applicable for the return of the Eligible Device.
    3. Under no circumstances Maxis shall be liable for any special, indirect, incidental or consequential damages resulting from the Program.

APPENDIX

Criteria and requirements for Eligible Device

 

Requirements

  1. Only for TV size of 32 inches and above.
  2. All TV models must be less than 10 years.
  3. Applicable for Whole West Malaysia excluding Pulau Ketam, Tioman, Langkawi & Pangkor.
  4. No payment for spoilt TV meaning anything that is broken, has no power, have line, have backlight, have heavy dot and have burn mark.
  5. Only for Plasma & LED TV.
  6. If no remote control or remote control is not working, RM 10 will be deducted.
  7. The TV must have SIRIM Sticker.
