Service Specific Terms and Conditions - RM1 Roaming Contract

    1. The Offer: RM1 Roaming Contract.
    2. The Services: Roaming services in selected countries.
    3. You: Person(s) signing up for the Offer.
    4. This Offer and use of the Service, Service is subject to the General Terms & Conditions (“GTC”), this Service Specific Terms & Conditions (“SSTC”), Maxis Fair Usage Policy and any other applicable terms and conditions, all www.maxis.com.my/FUP and www.maxis.com.my/terms-conditions/personal/
    5. Capitalised terms herein have the same meaning as defined in the GTC.
    6. Any conflict or inconsistency between this SSTC, the GTC and Summary Terms and Conditions (“STC”), shall be construed in the following order of precedence: (a) SSTC; (b) GTC; and (c) STC.
    7. We reserve the rights without liability, to revise this SSTC, the GTC, Offer and our pricing. Where reasonably practicable, we will give you reasonable advance notice of such changes and all previous versions of our user guides or leaflets will be superseded. You accept you are responsible for regularly reviewing information on the plan(s), Service or Service(s) at www.maxis.com.my/terms-conditions/personal/), including changes to the Agreement. Your continued use of the Service, Service(s), and/or plan(s) (after the Effective Date of any revision/change to the terms and conditions of the Agreement, Services, and/or plan(s)) shall constitute unconditional acceptance by you of such revisions/changes and you shall be bound by the same. If you do not accept such revisions/changes, you will terminate the Plan(s), Service and/or the use of the Service(s) by giving us notice within 28 days from the Effective Date failing which you are assumed to have accepted the changes.
    1. This Offer shall apply to the new and existing participants of these Maxis Postpaid rate plans: Maxis Postpaid 158/188/248/368 who do not have an existing device contract with Maxis.
    2. Upon accepting this Offer you agree that:
      1. Your Maxis Postpaid plan line will be contracted for and subject to a minimum commitment period of twelve (12) months commencing from the date of acceptance of this SSTC (“Minimum Commitment Period”);
      2. b. You will not be eligible to sign up any other Device contract with us within the Minimum Contract Period as stated in clause 9(a);
      3. c. Subject to Clauses 9(d) and 9(e), you are entitled to enjoy 12 months free roaming on selected countries based on your subscription of roaming services as follows:
        1. Singapore Roaming Contract offers roaming in Singapore, or
        2. ASEAN Roaming Contract offers roaming in 8 ASEAN countries as listed below:
          • Brunei, Cambodia, Indonesia, Myanmar, Laos, Philippines, Singapore, Thailand
      4. You are entitled to enjoy up to 20GB of high speed roaming data on selected countries based on your subscription of roaming services.
      5. e. You will experience data browsing on at reduced speeds in selected countries once your line exceeds 20GB of roaming data but with no excess charges.
    3. The allocation of countries that are available for free roaming will be determined by the rate plan which you registered for pursuant to the Offer and cannot be changed during the Minimum Commitment Period.
    4. Free roaming in selected countries is only applicable to the primary SIM card. For customers with multiple-SIM cards, secondary SIM cards will be subjected to normal roaming charges as updated by us on our website from time to time at https://www.maxis.com.my/lifestyle/roaming-idd/international-roaming/
    5. You are required to activate international roaming services (no cost) from your mobile in order to utilise the free service.
    6. You shall NOT during the Minimum Commitment Period:
      1. terminate your Maxis mobile account or port out to another mobile service provider;
      2. suspend your Maxis mobile account;
      3. have your Maxis mobile account terminated for non-payment of monthly bills;
      4. downgrade the Maxis Postpaid rate plan you had registered for pursuant to the Offer. However, any upgrade of a rate plan by you is allowed; or
      5. change or transfer ownership of this Offer and Service.
    7. If any of the events in Clause 13 above occurs, you shall pay us a penalty of RM300 for early termination fee of the Offer and the Services.
    8. During the Minimum Commitment Period, you can choose to upgrade your existing rate plan to a higher Maxis Postpaid plan. However, the Minimum Commitment Period shall continue to run and will not be extended after we process your request to upgrade to a higher Maxis Postpaid plan.
    9. Where your line is suspended, terminated or barred during the Minimum Commitment Period for any reason whatsoever, you agree that the Minimum Commitment Period will continue to run and you will not able to use roaming services whilst overseas.
    10. Upon the expiration of the Minimum Commitment Period, you will be subject to normal roaming charges as updated by us from time to time on our website at https://www.maxis.com.my/lifestyle/roaming-idd/international-roaming/. Charges published are exclusive of all applicable taxes.
    11. The Service is non-transferable, whether by operation of law or otherwise, either to any other person, entity or account.
    1. We reserve the rights at any time, without being liable to you or any third party, to interrupt, bar, suspend, restrict the Services for such time as we see fit or terminate, discontinue or disconnect the Services if your usage:
      1. shows excessive usage or placing unusual burdens on our Network;
      2. is for unlawful activities or for suspected fraudulent activities;
      3. is not in accordance with the Maxis Fair Usage Policy (at www.maxis.com.my/FUP); or
      4. is for commercial/non-personal purposes.
    1. Subject to Minimum Commitment Period and our GTC, a principal line holder may at any time terminate the Plan(s) as follows:
      1. By calling our customer care line at 1-800-82-1123 or dial 123 from your mobile;
      2. By walking into our Maxis Centres listed on www.maxis.com.my; or
      3. By writing in to customercare@maxis.com.my
