Service Specific Terms & Conditions ("SSTC") - Maxis Unlimited Postpaid and Home 4G WiFi

    1. The Plan: Maxis Unlimited Postpaid and Maxis Home 4G WiFi. Under the Plan, you will enjoy unlimited mobile internet data on your subscribed *Maxis Postpaid plan(s) when you successfully signed up to both Maxis Postpaid and Maxis Home 4G WiFi.
      (*The applicable Maxis Postpaid plan(s) under the Plan are Maxis Postpaid 98, 108, 128, 158 and 188)
    2. You: Person signing up for the Plan.
    3. If you move and/or change any of your current Service(s)’ rate plan to the Plan, you will not be able to carry forward any promotions/benefits that you are currently enjoying under your existing rate plan to the Plan you subscribed to.
    4. The Plan and use of the Service(s) under the Plan is subject to the General Terms & Conditions (“GTC”) at https://www.maxis.com.my/terms-conditions/personal/general/maxis-consumer/, this Service Specific Terms & Conditions (“SSTC”), Maxis Fair Usage Policy and any other applicable terms and conditions, all at www.maxis.com.my/terms-conditions/personal.
    5. Capitalised terms herein have the same meaning as defined in the GTC.
    6. Any conflict or inconsistency between this SSTC, the GTC and Summary Terms and Conditions (“STC”), shall be construed in the following order of precedence: (a) SSTC; (b) GTC; and (c) STC.
    7. Further, please note that:
      1. the Maxis Postpaid plan(s) under the Plan is subject to the SSTC – Maxis Postpaid (https://www.maxis.com.my/terms-conditions/personal/postpaid/maxis-postpaid/); and
      2. the Maxis Home 4G WiFi under the Plan are subject to SSTC – Maxis Home 4G WiFi (https://www.maxis.com.my/terms-conditions/personal/broadband/maxis-home-4g-wifi/).
      For clarity, any conflict or inconsistency between this SSTC, SSTC – Maxis Postpaid and SSTC – Maxis Home 4G WiFi, this SSTC shall take precedence.
    8. We reserve the rights without liability, to revise this SSTC, the Plan and our pricing. Where reasonably practicable, we will give you reasonable advance notice of such changes and all previous versions of our user guides or leaflets will be superseded. You accept you are responsible for regularly reviewing information on the Plan and Service(s) under the Plan at https://www.maxis.com.my/terms-conditions/personal/, including changes to the Agreement. Your continued use of the Service(s) and/or Plan (after the Effective Date of any revision/change to the terms and conditions of Services and/or the Plan) shall constitute unconditional acceptance by you of such revisions/changes and you shall be bound by the same. If you do not accept such revisions/changes, you will terminate the Plan and/or the use of the Services under the Plan by giving us notice within 28 days from the Effective Date failing which you are assumed to have accepted the changes.
    1. You are not eligible for the Plan if you have any outstanding payments with us.
    2. The Plan is not applicable to you if you are a commercial user and/or bulk subscriber.
    3. Notwithstanding the above, Maxis reserves the right to change the eligibility criteria for the Plan from time to time.
    1. The Plan's structure is published on our official website at https://www.maxis.com.my/family/maxis-unlimited-postpaid-home-4g-wifi/, as updated by us from time to time.
    2. The applicable Charges and rate table guide for the Plan is as set out on our official website at https://www.maxis.com.my/family/maxis-unlimited-postpaid-home-4g-wifi/. Charges and rates displayed do not include any applicable taxes.
    3. You are responsible for payment of all Charges associated with the Plan.
    1. Non-Malaysian is subject to payment of foreign deposit according to each of the Maxis Postpaid Plan and Maxis Home 4G WiFi.
    2. Non-payment for any one of the Services under the Plan may result in suspension or barring of all the Services under the Plan until the outstanding amount is paid.
    1. We reserve the rights at any time, without being liable to you or any third party, to interrupt, bar, suspend, restrict the Service(s) under the Plan (including downgrade your Maxis Postpaid plan) for such time as we see fit or terminate, discontinue or disconnect the Plan or the Service(s) under the Plan if your usage:
      1. shows excessive usage or placing unusual burdens on our Network;
      2. is for unlawful activities or for suspected fraudulent activities;
      3. is not in accordance with the Maxis Fair Usage Policy at https://www.maxis.com.my/terms-conditions/personal/general/maxis-fair-usage-policy/; or
      4. is for commercial/non-personal purposes.
    1. For data allocated with the Plan, you acknowledge and accept:
      1. if the combined mobile data usage of your principal line and your shared lines exceed 300GB in a month, Maxis may at its absolute discretion limit the quality of video streaming and/or browsing speed;
      2. the mobile internet package allocated within the Plan is exclusively for domestic usage only;
      3. you can opt for upgrades or downgrades of your Maxis Postpaid plan at any Maxis Service Centre or Maxis Exclusive Partners (MEP) or our call 123 from mobile; and
      4. if you upgrade or downgrade to another Maxis Postpaid plan, your monthly commitment fee will be pro-rated against your billing cycle date.
    1. The Charges and/or rates outlined in the Plan structure do not account for usages while on an overseas roaming network. For overseas roaming, the prevailing data roaming charges are available at https://www.maxis.com.my/lifestyle/roaming-idd/international-roaming/. Charges displayed do not include any applicable taxes.
    1. You will only be able to enjoy the benefits of the Plan after the successful activation of your subscribed (a) Maxis Postpaid plan; and (b) Home 4G WiFi under the Plan. For clarity:
      1. if for any reason, your subscribed Maxis Postpaid plan and/or Home 4G WiFi under the Plan fails to be activated or installed, your registration for the Plan will be deemed unsuccessful; and
      2. if only either of your subscribed Maxis Postpaid plan or Home 4G WiFi plan is successfully activated or installed, then only such plan will be deemed to have been registered. However, your registration for the Plan will be deemed unsuccessful.
    2. Upon successful registration for the Plan, both your registered Maxis Postpaid plan and Maxis Home 4G WiFi plan must be kept active and cannot be suspended for whatsoever reason to enable you to continue to enjoy the benefit(s) of the Plan.
    1. Subject to our GTC and this SSTC, a principal line holder may at any time terminate the Plan as follows:
      1. by calling our customer care line at 1-800-82-1123 or dial 123 from your mobile;
      2. by walking into our Maxis Centres listed on www.maxis.com.my; or
      3. by writing in to customercare@maxis.com.my.
    2. Upgrade or downgrade of the Maxis Postpaid plan under the Plan is allowed.
    3. Maxis shall have the right to immediately terminate the Plan if:
      1. you terminate either or both your Maxis Postpaid plan and/or Maxis Home 4G WiFi plan under this Plan; or
      2. if you transfer your Maxis Postpaid line or Maxis Home 4G WiFi line under the Plan to another account holder;
      3. after signing up to this Plan, you fail to make any payment for any Service(s) due to Maxis within 30 days of the statement due date.
    4. Upon termination of the Plan as per clause 23 above, all the benefit(s) under the Plan will automatically cease to be applicable to you. For the avoidance of doubt:
      1. if you have signed up for the Maxis Home 4G WiFi Device Contract Offer (“Device Contract Offer”), upon the termination of the Plan or the Maxis Home 4G WiFi plan, the Device Contract Offer will be terminated as well as per the SSTC for Maxis Home 4G WiFi Device Contract (available at https://www.maxis.com.my/terms-conditions/personal/broadband/maxis-home-4g-wifi-device-contract/and you may be liable for early termination charges, if applicable; and
      2. if only one of the Services under the Plan is terminated, the other remaining Services will continue as normal but without the benefit(s) of the Plan.
    5. For any planned interruption of Service(s) under the Plan, adequate notice will be provided via a valid mobile number and/or any other mode of communication as we may deem appropriate.
    1. Upon your subscription to the Plan, you are eligible to enter into selected device contracts with us, which are subject to the respective device contract terms and conditions including device warranty (if any). Subscription to the Plan does not affect your existing device contracts with us (if any).
    2. Upon your subscription to the Plan, you are no longer entitled to subscribe for the Share ‘n’ Surf Service (https://www.maxis.com.my/terms-conditions/personal/postpaid/mobile-internet/).
