Service Specific Terms & Conditions (“SSTC”) - Maxis Fibre Flash Deal Promotion

General

  1. The Promotion: Sign up for a new Maxis Fibre plan when you are being offered either (a) in your Maxis app; or (b) at the Maxis retail store; or (c) when you called Maxis at 123 (collectively as “Offer”) to enjoy:
    1. Maxis Unlimited Postpaid & Fibre; and/or
    2. additional benefit(s), as may be determined by Maxis from time to time.
    Offers are available for sign up for a limited time only. Terms and conditions apply.
  2. You: Person(s) signing up for an Offer under this Promotion, who must be an existing Maxis Postpaid customer.
  3. Promotion Period: 1 September 2020 to 1 September 2021. Any changes to the Promotion Period is subject to Maxis’ discretion.
  4. This Promotion and your use of the Service(s) is subject to the General Terms & Conditions (“GTC”), this Service Specific Terms & Conditions (“SSTC”), the Service Specific Terms & Conditions for Maxis Unlimited Postpaid and Fibre (“Maxis Unlimited Postpaid & Fibre SSTC”) available at https://www.maxis.com.my/terms-conditions/personal/family/maxis-unlimited-postpaid-fibre/, the Maxis Fair Usage Policy and any other applicable terms and conditions, all available at www.maxis.com.my/terms-conditions/personal/.
  5. Capitalised terms herein have the same meaning as defined in the GTC.
  6. Any conflict or inconsistency between this SSTC, the Maxis Unlimited Postpaid & Fibre SSTC, the GTC and Summary Terms and Conditions (“STC”), shall be construed in the following order of precedence: (a) this SSTC; (b) Maxis Unlimited Postpaid & Fibre SSTC; (c) GTC; and (d) STC.
  7. We reserve the rights without liability, to revise this SSTC, the GTC, this Promotion and our pricing. Where reasonably practicable, we will give you reasonable advance notice of such changes and all previous versions of our user guides or leaflets will be superseded. You accept you are responsible for regularly reviewing information on the plan(s) and Service(s) at www.maxis.com.my/terms-conditions/, including changes to the Agreement. Your continued use of the Service(s), and/or plan(s) (after the Effective Date of any revision/change to the terms and conditions of the Agreement, Services, and/or plan(s)) shall constitute unconditional acceptance by you of such revisions/changes and you shall be bound by the same. If you do not accept such revisions/changes, you will terminate the Plan(s) and/or the use of the Services by giving us notice within 28 days from the Effective Date failing which you are assumed to have accepted the changes.

Eligibility

  1. Selected existing Maxis Postpaid customer and the Maxis account must be registered under your name and is active during the Promotion. Selection of customers for each Offers under this Promotion is at Maxis’ sole discretion.
  2. You are not eligible for this Promotion if you have any outstanding payments with us.
  3. This Promotion is not applicable to you if you are a commercial customer and/or bulk subscriber.
  4. Notwithstanding the above, Maxis reserves the right to change the eligibility criteria for this Promotion from time to time.

This Promotion

  1. Each Offer is only available for sign up for a limited time only (“Offer Period”) and to selected eligible customers.
  2. Each Offer, upon a successful sign up, will entitle you to enjoy the Maxis Unlimited Postpaid & Fibre plan (subject to Maxis Unlimited Postpaid & Fibre SSTC). Additionally, it may come with other benefit(s), as may be determined by Maxis from time to time. The additional benefit(s) (if any) will be (a) reflected with the Offer when it appeared in your Maxis app; or (b) informed by the Maxis’ sales agent to you accordingly.
  3. You can only sign up for an Offer under this Promotion during the Offer Period:
    1. by using your Maxis app (when the Offer appeared in your Maxis app); or
    2. at the Maxis retail store (when the Offer is made available to you by Maxis’ sales agent); or
    3. during your call to Maxis at 123 (when the Offer is made available to you by Maxis’ sales agent).
  4. Within 7 days from signing up of an Offer under this Promotion, you will need to terminate your existing fibre service with your existing fibre service provider, including making any payment towards any amount due and owing to the service provider failing which, this Promotion shall lapse or may be terminated at Maxis’ sole discretion.

Charges

  1. The applicable Charges and the rate table guide for the rate plan for the Product and Service(s) is as set out on our website at https://www.maxis.com.my/family/maxis-unlimited-postpaid-fibre/.
  2. Charges displayed do not include all applicable tax.
  3. If the benefit(s) under the Offer include a rebate of the monthly charges of the Maxis Fibre plan, the applicable rebate and the Rebate Period (as defined in Clause 19 below) will be reflected in your Maxis Fibre monthly bill, during the Rebate Period.

Termination

  1. If the benefit(s) under the Offer include a rebate of the monthly charges of the Maxis Fibre plan, you MUST maintain both your Maxis Postpaid and Maxis Fibre Plan for the full duration of which the rebate will apply (“Rebate Period”). Any form of (a) termination of the Maxis Postpaid plan or Maxis Fibre plan; or (b) account separation of the Maxis Fibre and Maxis Postpaid plan during the Rebate Period; will result in the termination of the Offer under this Promotion.
  2. You will no longer be entitled to the benefit(s) under this Promotion if any of the following events occurs for any reason whatsoever, during a period of 24 months (commencing from the date of successful onsite installation and activation of the Maxis Fibre at your premises):
    1. terminate your Maxis Fibre plan or Maxis Postpaid plan;
    2. suspend your Maxis Fibre plan or Maxis Postpaid plan;
    3. have your Maxis Postpaid plan or Maxis Fibre plan terminated for non-payment of monthly bills;
    4. request for a relocation of the Maxis Fibre line; or
    5. apply to transfer the account of your Maxis Fibre plan to a new account holder.

Additional Features & Requirements

  1. This Promotion is not exchangeable for cash.
  2. This Promotion is not transferable.
  3. This Promotion is not applicable to Maxis employees (permanent or contract).
  4. This Promotion is only applicable to one customer per Maxis Fibre line.
  5. This Promotion is not applicable with any other Maxis Fibre campaign or promotions.
