Maxis App Service Terms & Conditions:

The Maxis App Service (“Maxis App”) is brought to you by Maxis Mobile Services Sdn Bhd (“Maxis”) and provided to you subject to the terms and conditions set out herein. You acknowledge and agree that you have read and fully understood all these terms and conditions.

  1. Maxis App allows you access to Maxis customer services & general information through your mobile device & is provided subject to Maxis’ terms & conditions. Please refer to the Maxis website the Hotlink website for the latest version of Maxis’ terms and conditions. By accessing the Maxis App, you agree to be bound by these Maxis App terms & conditions, which may be amended from time to time, in addition to which the Maxis terms and conditions as mentioned above shall continue to bind you.

  2. Not all mobile devices support the Maxis App. You should check whether your mobile device is compatible before using the Maxis App.

  3. Certain features of the Maxis App may require the input of your postpaid mobile number & PIN registered in Maxis’ Online account or prepaid username & password registered in the Hotlink Account. You are solely responsible for the security, confidentiality & privacy of your PIN/password & any data or information stored on your mobile device and/or for all the activities related to the Maxis App. Maxis will not be liable for any damage, loss or leakage of the data or information resulting from unauthorized use of the Maxis App or due to circumstances beyond Maxis’ control.

  4. An auto-login option is provided where the mobile device will cache your password to log you in to the Maxis App automatically. This is provided as a convenience to you. You are advised to be cautious when activating this feature; and only do so if your mobile device has other security features to prevent access to apps by unauthorized persons. By enabling Auto-Login, you accept the responsibility & liabilities for all activities and/or transactions that occur under your password/PIN authentication. Should you have any reason to believe that access to your account has been misused and/or compromised whether by theft, fraud or otherwise, you should change your password immediately and inform Maxis to help limit the exposure of the incident.

  5. You agree that all information you provide to Maxis for registration to the Maxis App (“Registration Data”) will be true, accurate, complete and current information and that you shall maintain and update the Registration Data as needed throughout the period of your use of the Maxis App to keep it accurate and current. Failure to provide accurate, current and complete Registration Data may result in the suspension and/or termination of your access to the Maxis App.

  6. Certain features of the Maxis App may require access to location services such as the cellular network & data connection in order to determine an approximate location of your mobile device.

  7. Any data retrieval or re-direction to other websites from the Maxis App will incur mobile data charges.

  8. If you use the Maxis App overseas, additional roaming & mobile data charges will apply. For more information on international roaming & charges, please visit http://www.maxis.com.my/.

  9. You expressly understand & agree that your use of the Maxis App is at your own risk & that the Maxis App is provided on an “AS IS” & “AS AVAILABLE” basis & we expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to fitness for a particular purpose & non-infringement and/or that the Maxis App will be free from loss, corruption, attack, viruses, interference, hacking or other security intrusion or that the Maxis App will be affected by unforeseen circumstances or circumstances beyond Maxis’ control.

  10. Maxis, its related and affiliated corporations shall not be liable to you or your agents for any loss or injury or any direct, indirect, special, exemplary, consequential damages, or any damages whatsoever, whether in contract, negligence or in tort, you and/or any third party may suffer as a result of instructions or transactions transmitted via the Maxis App after successful authentication whether or not such usage was authorised by you and/or arising out of or in connection with the Maxis App and/or your or any other party’s access and/or use of the Maxis App.

  11. You agree to defend, indemnify and hold Maxis, its related and affiliated corporations harmless from any claim or demand, loss and/or damage relating to or arising from: (a) your and/or third party (whether or not authorised by you) usage of the Maxis App; (b) any violation by you of the Maxis App terms and conditions; or (c) your violation of any rights of another through your usage of the Maxis App.

  12. Maxis may update or change these Maxis App terms & conditions, the Maxis and Hotlink websites from time to time. You are responsible for regularly reviewing the current version of the terms and conditions for the Maxis App, Maxis and Hotlink website to obtain notice of any such changes. Your continued access into and usage of the Maxis App shall be construed as you having accepted all such changes. All matters & disputes will be subject to our final decision.

  13. Termination

    2. Maxis reserves the right to modify, suspend or discontinue the Maxis App at any time and will not be liable to you or any third party should it exercise such rights. To the extent possible, Maxis will inform you in advance of any modification, suspension or discontinuance of the Maxis App.

Maxis may at any time immediately terminate or suspend your access to the Maxis App. The circumstances for termination shall include, but is not limited to,: (a) your violations or breach of these Maxis App and Maxis’ terms and conditions of service or any other policies or guidelines that are referenced herein and/or posted with regard to the Maxis App and/or Maxis’ terms and conditions of service; (b) discontinuance or material modification to the Maxis App or any part thereof; (c) a request and/or order from law enforcement, judicial or statutory body or other government agency; (d) where provision of the Maxis App to you is or may become unlawful; (e) unexpected technical or security issues or problems with the Maxis App; or (f) your failure to pay any fees and/or charges owed by you in relation to the Maxis App and/or Maxis services subscribed by you.

    8. Termination of the Maxis App shall not relieve you of any obligation to pay any accrued charges and/or fees associated with the Maxis App up to and including the date of termination.
