Committed to the Game - Biggest Fan

CONTEST ELIGIBILITY

The Biggest Fan Contest ("Contest") is organized by Maxis Mobile Services Sdn Bhd (‘Maxis’) and is open to all Malaysian Maxis subscribers whom are citizens or residents. This includes:

a. Maxis Postpaid subscribers
b. Hotlink Pre-paid subscribers
(“collectively, Maxis Subscriber(s)”)

Employees of Maxis and the Maxis group of companies, their associated agencies, dealers, distributors, sponsors and immediate families are not allowed to participate in this Contest.
Maxis Subscribers will not be eligible for the Contest if their Maxis accounts are not in Good Standing. Good Standing in this Contest means, the account(s) must not be suspended, limited, terminated or past due for payment as of 28th May 2010 and during the Contest and prize giving period. In the event any account is suspended, cancelled or terminated at any time for any reason during the Contest Period, Maxis shall at its sole discretion, revoke the eligibility for such Maxis Subscribers or account holder(s) to participate in the Contest, without incurring any liability whatsoever to the participant and/or the Maxis Subscriber and/or without giving any prior notice.

ELIGIBILITY

Age eligibility for participants is 12 years old and above. Participants below 18 years old must obtain and provide Maxis with a formal parental/ guardian consent. The Maxis Subscriber parent/guardian of the participants acknowledges and agrees that these Contest terms and conditions shall be binding upon them and agree to allow his/her child to participate in this Contest.

In the event the participant wins but fails to provide Maxis with the said parental/ guardian consent, Maxis shall forfeit the Prize without any liability whatsoever to the participant and/or the Maxis Subscribers.
In the event the Winner and/or his/her accompanying companion of the prize (“Accompanying Companion”) is below 18 years old, the said Winner and/or his Accompanying Companion must be accompanied by either one of his/her parents or his/her rightful guardian (who is above 21 years of age). Maxis shall not bear any additional cost and/or liability to enable the Winner or his Accompanying Companion to comply with this requirement. In the event the Winner or his Accompanying Companion fails to be accompanied by his/her parent or his/her rightful guardian (who is above 21 years of age), Maxis reserves the right to forfeit the Prizes without any liability whatsoever to the participant and/or the Maxis Subscriber.

CONTEST RULES

The Contest shall run from 8th June 2010 to 12th July 2010 ("Contest Period").
Participants and/or the Maxis Subscribers are required to upload their videos via YouTube or pictures to Flickr, Photo Bucket or any other photo sharing site and provide us with the link using the SUBMIT form at www.maxis.com.my/FIFAworldcup
Participants and/or the Maxis Subscribers may submit as many entries as desired.
Entries with the most interesting video or picture will be shortlisted and chosen to

a) win the prize.

At the end of the campaign, Maxis will choose from the shortlisted number and award

a) the prizes to the contestants deemed “The Biggest Fan”.

Participants and/or the Maxis Subscribers acknowledge and undertake that every entry they submit is original, genuine, creative and created by them and not by any other person or copied from any other person or source.

Proof of an entry(ies) sent by the participant and/or Maxis Subscriber does not denote proof that Maxis received the entry(ies). Participants and/or the Maxis Subscribers must ensure that their entries are complete. Incomplete, illegible or late entries shall be disqualified. Maxis shall not be responsible and/or liable for any entries that are late (including delayed data transmissions), tampered with, incomplete, misdirected, lost, delayed, corrupted, duplicated or otherwise entries not in compliance with these terms and conditions. Sending of, including but not limited to, poor quality, blurry and unclear videos and/or pictures are discouraged and Maxis shall not be held responsible or liable for any poor quality images of the videos and/or pictures sent by any participant and/or Maxis Subscriber.
The participants and/or Maxis Subscribers hereby assigns and agrees to assign to Maxis all the participants’ and/or Maxis Subscribers’ rights, title and interest to each entry submitted, for the full copyright period and confirms that the entries made in connection with the Contest shall be the property of Maxis.
The participants and/or Maxis Subscribers hereby agrees that the participants’/his/her and/or Maxis Subscribers’ entry in this Contest shall not contain anything which is an infringement of intellectual property rights of another party, including but not limited to copyright, trademarks or service marks, or which is or is not calculated to bring Maxis into disrepute or breach of contract or duty of confidence or which is defamatory or in contempt of court or calculated to bring or brings Maxis into disrepute.

CONTEST PRIZE

Prizes are as follows:

20 x Meet and Greet tickets comprising of:
a. 10 tickets to meet Lionel Messi in Barcelona
b. 10 tickets to meet Frank Lampard in London

Meet & Greet prize includes an all expense paid 3 days 2 nights trip for 2 people to the selected country. This includes flight tickets, lodging, visa charges and meals.

CONTEST WINNERS

Prize winners will win a pair of tickets (2 tickets) each to meet either Messi or Lampard.
Prize winners are only entitled to one (1) prize each.
This Meet & Greet session currently is scheduled during the month of September 2010. Prize winners will be notified of the actual date upon winning. Should there be any changes in date, prize winners will be notified 3 weeks prior to travel date.
Prize winners will be contacted by phone or email and will also be announced at www.maxis.com.my/FIFAworldcup. The eligibility of prize winners is subject to them being contactable within seven (7) days of the date of their selection.
Prize winners must produce their original new IC and/or parental/guardian consent to participate in the Contest as proof of identity. Prizes are not exchangeable for cash or other items and not transferable to other individuals
Prize winners must claim their prizes from Maxis within one (1) month of being notified. Any cost incurred in collecting the prizes shall be borne by the prize winners.
Maxis reserves the right to substitute any prize with another of a similar value at any time without prior notice.
Winners are responsible for any taxes, fees or charges payable in respect of any prizes awarded to them.
Acceptance of the prize/gift constitutes permission to Maxis and its agencies to use the winner's name, photograph and/or likeness for purposes of advertising and trade without further compensation and notice, unless prohibited by law.

RIGHTS

Maxis reserves the right :

to change, amend, revise, supplement, delete, vary or add to these Terms & Conditions without prior notice at any time and you shall be bound to such changes, amendments, revisions, supplements, deletions, variations or additions.
at any time, to change any aspect of the Contest (including the Prizes and discontinuing the Contest) without prior notice.
at its sole discretion, to cancel, suspend, modify or delay the Contest or tabulation of votes in the event of unforeseen circumstances beyond its reasonable control.

By continued participation in this Contest, you will be deemed to have accepted any changes, amendments, revisions, supplements, deletions, variations or additions, which may be published on www.maxis.com.my
The Contest terms and conditions shall be read in addition to the terms and conditions of the Maxis mobile registration form (“Principal Terms & Conditions”) entered into and accepted by the participant/Maxis Subscriber and shall be supplemental to the principal Terms & Conditions. The Principal Terms and Conditions shall continue to apply and bind the participant and/or the
The due observance and fulfillment of the Contest terms and conditions in so far as they relate to anything to be done or complied with by the participant and/or Maxis Subscriber shall be conditions precedent to any entitlement (if any) of the participant and/or Maxis Subscriber to receive a prize and/or reward pursuant to this Contest.
Maxis reserves the right, in its sole discretion, to disqualify any participant and/or Maxis Subscriber that is found or suspected of tampering with the Contest submission process, the operation of this Contest or to be in violation of the conditions of access of the web-site and/or in breach of the terms and conditions of this Contest.

Maxis reserves the right to disqualify any participant and/or Maxis Subscriber and/or to forfeit any prize and/or reward from a participant and/or Maxis Subscriber it believes has undertaken fraudulent practice and/or activities or other activities harmful to this Contest or the Contest submission process. Fraudulent activities are deemed to include, but is not limited to, the following:

Any act of deceit and/or deception and/or cheating;
Submission of entries by any person other than the natural person who is the named Maxis Subscriber participating in the Campaign; and/or
Submission of answers and/or entries and/or responses wholly or partially by way of and/or generated by way of any electrical device, computer, pre-programmed modem or by any other method or device which contravenes the submission of entries in part (b) herein above.

This Contest and the Prize are provided on an “AS IS” basis without any representations or warranties of any kind whether express or implied. Maxis, its related and affiliated corporations disclaim and exclude all warranties relating to or in connection with the Contest and the Prize including warranties of merchantability, fitness for a particular purposes, security and accuracy.
Maxis reminds Maxis Subscribers/participants of the nature and limitations of technology and is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software failure that may affect the Contest or participation in the Contest in any way.
